JAMES CONNOLLY MEMORIAL HOSPITAL BOARD (ESTABLISHMENT) ORDER 1971, (AMENDMENT) ORDER 1977.

The Minister for Health in exercise of the powers conferred on him by sections 3 to 6 of the Health (Corporate Bodies) Act, 1961 (No. 27 of 1961) hereby orders as follows :—

1. This Order may be cited as the James Connolly Memorial Hospital Board (Establishment) Order, 1971 (Amendment) Order, 1977.

2. The James Connolly Memorial Hospital Board (Establishment) Order, 1971 ( S.I. No. 97 of 1971 ) shall be amended as follows :—

(i) The following article shall be substituted for article 5—

"5. The Board shall consist of seventeen members appointed as follows:—

(a) six by the Eastern Health Board which may include not more than two officers of the said body or of any hospital board to which the said body is entitled to nominate or appoint members;

(b) three by the Board of Management of the Mater Misericordiae Hospital, Dublin;

(c) three by the Board of Governors of St. Laurence's Hospital, Dublin;

(d) three by the Committee of Management of the Charitable Infirmary, Jervis Street, Dublin;

(e) two by the North-Eastern Health Board which may include not more than one officer of the said body."

(ii) The following sub-articles shall be substituted for sub-article (2) of article 6: —

"(2) The term of office of the first members appointed to the Board by the North-Eastern Health Board shall commence on 1st June, 1977.

(3) The term of office of a member of the Board shall, unless he sooner dies, resigns, or ceases to be a member under article 8 of this Order, terminate—

(a) in the case of a member appointed by the Eastern Health Board who, on appointment, was a member of the Eastern Health Board—on the day of the first meeting of the Eastern Health Board after an appointment of members made following a quinquennial election of the members of the local authorities appointing members of the said Health Board;

(b) in the case of a member appointed by the North-Eastern Health Board who, on appointment, was a member of the North-Eastern Health Board—on the day of the first meeting of the North-Eastern Health Board after an appointment of members made following a quinquennial election of the members of the local authorities appointing members of the said Health Board;

(c) in the case of any other member of the Board, subject to paragraph (d) of this sub-article—at the end of five years in respect of the first members of the Board and, in respect of subsequent members of the Board—at the end of such period, not exceeding three years, as may be determined by the body appointing such members;

(d) in the case of a member who on appointment, was an officer mentioned in either article 5 (a) or article 5 (e) of this Order— on his ceasing to hold such office during the period of his membership of the Board."

(iii) Article 9 shall be amended by the deletion of the words "or the Dublin Health Authority".

(iv) The following sub-article shall be substituted for sub-article (1) of article 19—

"(1) The Board may appoint committees, which may include persons who are not members of the Board, to assist the Board in relation to aspects of its day-to-day business and to furnish advice on particular aspects of its functions."

(v) The following sub-article shall be substituted for sub-article (2) of article 21—

"(2) The financial year of the Board shall be the period of twelve months ending on 31st day of December in any year and for the purposes of this provision the period commencing on the 1st April, 1977 and ending on the 31st December, 1977, shall be deemed to be a financial year."

EXPLANATORY NOTE.

The effect of this Order is to increase the membership of the James Connolly Memorial Hospital Board from fifteen to seventeen members to provide for the appointment of two members by the North-Eastern Health Board to the Board. Minor amendments in procedure as defined in the original Order are also included.
