RETAIL PRICES (FOOD) DISPLAY ORDER, 1977.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by section 19 (as amended by the Prices (Amendment) Act, 1972 (No. 20 of 1972) ) and section 20 of the Prices Act, 1958 (No. 4 of 1958), hereby orders as follows:

1. This Order may be cited as the Retail Prices (Food) Display Order, 1977.

2. This Order shall come into operation on the 9th day of May, 1977.

3. Subject to Article 5 (a) of this Order, every person who carries on in the State the business of selling by retail any commodity mentioned in Part I of the Schedule to this Order shall display a notice at the shop, vehicle or other place where the business is carried on and the notice shall—

(a) specify every commodity mentioned in the said Part I which is on sale by retail at the shop, vehicle or other place,

(b) specify opposite the mention of each such commodity the retail price (calculated by reference to the number or the unit of weight, as the case may be, specified in the said Part opposite the mention of that commodity therein) charged at the shop, vehicle or other place for the commodity,

(c) specify, opposite the mention of the retail price of each such commodity, the number or the unit of weight, as the case may be, specified in the said Part opposite the mention of that commodity therein.

4. Subject to Article 5 (b) of this Order, every person who carries on in the State the business of selling by retail any commodity mentioned in Part II of the Schedule to this Order shall display a notice at the shop, vehicle or other place where the business is carried on and the notice shall—

(a) specify every commodity mentioned in the said Part II which is on sale by retail at the shop, vehicle or other place,

(b) specify opposite the mention of each such commodity the retail price (calculated by reference to the unit of weight specified in the said Part opposite the mention of that commodity therein) charged at the shop, vehicle or other place for the commodity,

(c) specify, opposite the mention of the retail price of each such commodity, the unit of weight specified in the said Part opposite the mention of that commodity therein.

5. (a) Article 3 of this Order shall not apply to a person in respect of a shop, vehicle or other place at which he carries on the business of selling by retail bacon of a kind mentioned in Part I of the Schedule to this Order but not any other commodity mentioned in that Part.

(b) Article 4 of this Order shall not apply to a person in respect of a shop, vehicle or other place at which he carries on the business of selling by retail rashers of bacon of a kind mentioned in Part II of the Schedule to this Order but not any other commodity mentioned in that Part and a commodity (other than rashers of bacon) of a kind mentioned in Part I of the said Schedule.

6. Where a person is required by virtue of both Articles 3 and 4 of this Order to display notices at a shop, a copy of the notice required to be displayed by the person at the shop by virtue of the said Article 4 shall be displayed at any place in the shop where commodities specified in Part II of the Schedule to this Order are sold or displayed for sale separately from any commodities specified in Part I of the said Schedule.

7. A notice displayed pursuant to Article 3 or 4 of this Order shall—

(a) if it is at a shop, be in such a position as to be clearly visible and easily accessible to all persons frequenting the shop before entering the shop, and

(b) if it is at a vehicle or other place referred to in the said Articles 3 and 4, be in such a position as to be clearly visible and easily accessible to all persons in the immediate vicinity of the vehicle or other place, as the case may be.

8. A notice displayed pursuant to Article 3 or 4 of this Order shall—

(a) if it is displayed at a shop, be in such form as to be capable of being easily read by all persons frequenting the shop before entering the shop, and

(b) if it is displayed at a vehicle or other place, be in such form as to be capable of being easily read by all persons frequenting the vehicle or other place,

and the letters and figures on the notice shall be at least 1.27 centimetres in height and of proportionate width.

9. A copy of a notice displayed in a shop pursuant to Article 6 of this Order shall be in such a position as to be clearly visible and easily accessible to all persons frequenting the shop for the purpose of buying a commodity specified in the notice and shall be in such form as to be capable of being easily read by all such persons and the letters and figures on the copy shall be at least 1.27 centimetres in height and of proportionate width.

10. The Retail Prices (Food) Display Order, 1973 ( S.I. No. 170 of 1973 ), is hereby revoked.

EXPLANATORY NOTE.

This Order requires every person who carries on the business of selling by retail any of the commodities set out in the Schedule to the Order to display, in a specified manner, the retail price charged by him for each such commodity.
