ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1977.

The Minister for Local Government in exercise of the powers conferred on him by sections 6 and 12 of the Roads Act, 1920, section 1 (as amended by section 20 of the Finance Act, 1958 (No. 25 of 1958) and section 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following regulations:—

1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1977.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations 1958 to 1976, shall be construed together as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1977.

(3) These Regulations shall come into operation on the 1st day of May, 1977.

2. In these Regulations—

"the Principal Regulations" means the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ).

3. Sub-article (5) of article 1 of the Principal Regulations is hereby amended by the insertion before the definition of "dealer" of the following definition—

" 'bicycle' means a mechanically propelled bicycle (including a motor scooter, a bicycle with an attachment for propelling it by mechanical power and a mechanically propelled bicycle used for drawing a trailer or sidecar) not exceeding 8 cwt. in weight unladen".

4. Sub-article (1) of article 17 of the Principal Regulations is hereby amended by the insertion after "Department of State" of "or to any local authority exercising functions pursuant to the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975)".

5. Paragraph (a) of sub-article (2) of article 17 of the Principal Regulations is hereby amended by the substitution of "fifty pence" for "one shilling".

6. (1) Sub-article (2) of article 20 of the Principal Regulations is hereby amended by the substitution for "on the front of and on the back of" of—

"(a) in the case of a bicycle, on the back of the vehicle;

( b ) in the case of any other vehicle, on the front of and on the back of"

(2) Sub-article (3) of article 20 of the Principal Regulations is hereby amended by the insertion after "Where a vehicle", of "(other than a bicycle)".

(3) Paragraph 4 of the Third Schedule of the Principal Regulations as substituted by article 5 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1969 ( S.I. No. 205 of 1969 ) is hereby amended by the insertion after "on a vehicle" of "(other than a bicycle)".

7. Sub-article (1) of article 8 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1958 ( S.I. No. 198 of 1958 ) is hereby amended by the addition of the following clause—

"(c) where a licence is surrendered under clause (d) or (e) of article 3 of these Regulations, (as amended by article 7 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1968 ( S.I. No. 147 of 1968 )), at the rate of eight per cent of the full annual rate of duty for every month of the licensing period unexpired at the time of surrender of the licence".

EXPLANATORY NOTE.

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ), the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1958 ( S.I. No. 198 of 1958 ) and the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1969 ( S.I. No. 205 of 1969 ) so as to provide: —

(1) that licensing authorities may supply free of charge full particulars of any vehicle registered with them to any local authority operating a traffic warden service;

(2) that the existing charge for the supply of certain registration particulars shall be increased to 50p;

(3) that the identification marks assigned to a bicycle (which is defined in these Regulations) need not be displayed at the front of the vehicle; and

(4) for the calculation of refunds of duty in certain cases where motor vehicle duty licences are surrendered.
