MINISTERIAL AND PARLIAMENTARY OFFICES (SALARIES) ORDER, 1977.

The Government, in exercise of the powers conferred on them by section 8 A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted therein by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 ), hereby make the following order with respect to which, pursuant to the said section 8A, a draft has been laid before Dáil Éireann and a resolution disapproving of the draft has not been passed by Dáil Éireann within the next subsequent twenty-one days on which it has sat after the draft was laid before it:

1. This Order may be cited as the Ministerial and Parliamentary Offices (Salaries) Order, 1977.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Agreement of 1972" means the National Agreement, 1972, of the Employer-Labour Conference ratified on the 31st day of July, 1972;

"the Agreement of 1974" means the Employer-Trade Union National Agreement of the Employer-Labour Conference ratified on the 7th day of March, 1974;

"the Agreement of 1975" means the Employer-Trade Union National Agreement of the Employer-Labour Conference ratified on the 22nd day of April, 1975, and revised on the 24th day of September, 1975.

3. (1) Each of the annual sums specified in paragraph (2) of this Article shall be and be deemed to have been increased—

(a) With effect from the 1st day of June, 1975—

(i) by an amount calculated in accordance with Clause 3 (c) of the Agreement of 1975, and

(ii) by an amount calculated in accordance with Clause 3 (b) (i) of the Agreement of 1972, as applied by Clause 3 (f) of the Agreement of 1974 and Clause 3 (h) of the Agreement of 1975,

(b) with effect from the 1st day of September, 1975, by an amount calculated in accordance with Clause 3 (d) of the Agreement of 1975, and

(c) with effect from the 1st day of December, 1975, by an amount calculated in accordance with Clause 3 (b) (i) of the Agreement of 1972, as applied by Clause 3 (f) of the Agreement of 1974 and Clause 3 (h) of the Agreement of 1975.

(2) The annual sums referred to in paragraph (1) of this Article are—

(a) any annual sum payable by way of salary under subsection (1) or (2) of section 3 of the Act of 1938 (inserted by section 7 of the Act of 1973),

(b) the annual sum so payable under section 4 of the Act of 1938 (inserted by section 8 of the Act of 1973), when the person concerned is a member of the Oireachtas,

(c) any annual sum so payable under section 5 (1) of the Act of 1938 (inserted by section 9 of the Act of 1973), and

(d) any annual sum so payable under section 6 (1) of the Act of 1938 (inserted by section 10 of the Act of 1973).

4. The annual sum payable under section 4 of the Act of 1938 (inserted by section 9 of the Act of 1973) shall, where the person concerned is not a member of the Oireachtas, be and be deemed to have been increased—

(a) with effect from the 1st day of June, 1975—

(i) by an amount calculated in accordance with Clause 3 (c) of the Agreement of 1975, and

(ii) by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1972, as applied by Clause 3 (f) of the Agreement of 1974 and Clause 3 (h) of the Agreement of 1975,

(b) with effect from the 1st day of September, 1975, by an amount calculated in accordance with Clause 3 (d) of the Agreement of 1975, and

(c) with effect from the 1st day of December, 1975, by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1972, as applied by Clause 3 (f) of the Agreement of 1974 and Clause 3 (h) of the Agreement of 1975,

EXPLANATORY NOTE.

This Order increases the allowances of Members of the Government and Parliamentary office holders in accordance with the first and second phase increases of the National Agreement 1975 and the substitution increases due under the National Agreement 1974.
