HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1977.

I, TOM FITZPATRICK, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (New Ross Harbour) Order, 1977.

(2) This Order shall some into operation on the 31st day of January, 1977.

2. The Harbour Rates (New Ross Harbour) Order, 1949 ( S.I. No. 230 of 1949 ), is hereby amended by—

(a) the substitution for the Second Schedule thereto (inserted by the Harbour Rates (New Ross Harbour) Order, 1974 ( S.I. No. 359 of 1974 )) of the following:

"SECOND SCHEDULE

MAXIMUM TONNAGE RATES.

Tonnage rates on vessels other than those described in paragraphs 2 to 8 below inclusive:

(a) on every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel discharging or loading in the harbour

(b) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel entering and leaving the harbour without cargo, or entering and leaving the harbour with the same cargo, or for the purpose of seeking refuge a sum not exceeding

(c) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel lying up in the harbour after the expiration of 28 days for each succeeding month or part thereof, a sum not exceeding

On every river craft which plies regularly between any points in Waterford harbour and New Ross harbour or within the limits of New Ross harbour either:

(a) per cargo or part cargo laden or discharged in New Ross harbour a sum of:

or

(b) at the option of the owner an annual sum payable yearly in advance on the 1st January of:

3.

On every river craft not included in 2. above per cargo or part cargo laden or discharged in New Ross harbour a sum of:

4.

On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel, barge or lighter constructed in New Ross and exported through the port to any port or place

On every passenger carrying Vessel, other than seagoing passenger vessels, operating in the Port of New Ross per trip the sum of

or

At the option of the owner, an annual sum payable in advance on the 1st January, not exceeding

£20·00

6.

On every hired Cruiser entering or leaving the Port of New Ross a sum not exceeding

£1·00

7.

On every pleasure craft entering or leaving the Port of New Ross, a sum of

50p

or

At the option of the owner an Annual sum payable in advance on the 1st January not exceeding

£2·50

8.

On every open salmon boat, an annual sum payable on the 1st January in advance, not exceeding

£1·00

", and

(b) the substitution for the Third Schedule thereto (inserted by the Harbour Rates (New Ross Harbour) Order, 1974) of the following:

"THIRD SCHEDULE.

MAXIMUM SERVICE RATES.

(a) Ships carrying not more than 750 tons

For the attendance of Harbour Constable at loading or discharging of hazardous cargoes

£3·00 per hour

or

so much of the remuneration of the Constable as is attributable to the time spent by him in attendance during the loading or discharging, whichever is the greater sum

4.

For the provision of fresh water at the Commissioners' wharves

25p per 1,000 gallons, together with any labour charges incurred.

5.

Wharfage rates

At the Pontoon Wharf

£0·01 per ton of cargo loaded or discharge.

At the Commissioners' permanent wharves

50% of the appropriate goods rate.

6.

For slipping or un-slipping any Vessel, a sum not exceeding

50p per vessel.

EXPLANATORY NOTE.

This Order authorises the New Ross Harbour Commissioners to introduce new tonnage and service charges at the port of New Ross.
