SOCIAL WELFARE (DESERTED WIFE'S ALLOWANCE) (AMENDMENT) REGULATIONS, 1976.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and sections 21 and 22 of the Social Welfare Act, 1970 (No. 12 of 1970), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Deserted Wife's Allowance) (Amendment) Regulations, 1976.

(2) These Regulations and the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1974, may be cited collectively as the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1976.

2. These Regulations shall come into operation on the 11th day of June, 1976.

3. Article 8 of the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 ( S.I. No. 227 of 1970 ) is hereby amended by the substitution in sub-article (1) for the words "and 63." of the words "63 and 80 (2)." and by the insertion after sub-article (3) of the following sub-article—

"(4) In the application of section 80 (2) of the said Act any reference to "widow's (non-contributory) pension under the Widows' and Orphans' Pensions Acts, 1935 to 1952" shall be construed as including an allowance."

EXPLANATORY NOTE.

These Regulations amend the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1974, by providing that a person who, immediately before attaining pensionable age, is in receipt of a deserted wife's allowance shall not be required to satisfy the residence conditions for old age (non-contributory) pensions purposes imposed by section 2 of the Old Age Pensions Act, 1932 .
