HARBOUR RATES (GALWAY HARBOUR) ORDER, 1976.

I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of the said Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Galway Harbour) Order, 1976.

(2) This Order shall come into operation on the 23rd day of May, 1976.

2. The Harbour Rates (Galway Harbour) Order, 1947 (S. R. & O., No. 162 of 1947), is hereby amended by—

( a ) the substitution for the First Schedule thereto (inserted by the Harbour Rates (Galway Harbour) (No. 2) Order, 1973 ( S.I. No. 329 of 1973 )), of the following:

Goods not belonging to any of the classes of goods in respect of which the Commissioners are otherwise authorised to charge goods rates shall, for the purpose of charging goods rates thereon, be treated by the Commissioners as belonging to such of the said classes of goods, as in the opinion of the Commissioners, is most appropriate. ( Section 99 of Harbours Act 1946 )."

( b ) the substitution for the Second Schedule thereto (as amended by the Harbour Rates (Galway Harbour) Order, 1947 (Amendment) Order, 1957 ( S.I. No. 183 of 1957 ), and the Harbour Rates (Galway Harbour) Order, 1947 (Amendment) Order, 1960 ( S.I. No. 260 of 1960 )), of the following—
