Public Hospitals (Amendment) Act, 1976

Amendment of Public Hospitals Act, 1933.

1.—The Public Hospitals Act, 1933 , is hereby amended by the substitution of the following section for section 12 , as amended by the Public Hospitals Act, 1940 :

“12.—(1) The balance of the moneys received from the sale of tickets in a sweepstake held under this Act remaining after paying or providing for the prizes distributed in such sweepstake, the expenses incurred in holding such sweepstake, and any duty or tax chargeable in respect of such balance shall be paid to the Hospitals Trust Board.

(2) The following limitations shall apply in respect of the application of the moneys received from the sale of tickets in a sweepstake held under this Act:

(a) the amount applied out of such moneys for paying the expenses incurred in holding such sweepstake (other than tickets, commission, prizes or other remuneration given in relation to the sale of tickets) shall not exceed forty per cent. of such moneys or such lesser percentage of such moneys as the Minister for Justice may, when sanctioning the scheme for such sweepstake, determine;

(b) where a payment is made to a person for promoting such sweepstake, such payment shall be deemed for the purposes of this Act to be part of the expenses of holding such sweepstake;

(c) the amount paid in pursuance of this section to the Hospitals Trust Board in respect of any sweepstake, together with the amount of any duty or tax chargeable in respect of the moneys or any part of the moneys received from the sale of tickets in such sweepstake, shall not be less than thirty per cent. of the said moneys received from the sale of tickets in such sweepstake.”.
