INFECTIOUS DISEASES (MAINTENANCE) (AMENDMENT) REGULATIONS, 1975.

The Minister for Health, in exercise of the powers vested in him by section 5 and subsection (5) of section 44 of the Health Act, 1947 (No. 28 of 1947), hereby makes the following Regulations:

1. These Regulations may be cited as the Infectious Diseases (Maintenance) (Amendment) Regulations, 1975.

2. These Regulations shall come into operation on the 1st day of October, 1975.

3. The Infectious Diseases (Maintenance) Regulations, 1975, ( S.I. No. 40 of 1975 ) are hereby amended by the substitution for the Schedule thereto of the Schedule to these Regulations.

PART I

Class of Person

1. ( a ) For a person with a dependent spouse

( b ) For a person with a dependent spouse where such person or such spouse is receiving in-patient services

PART II

Circumstances in which the sum specified in Part One of this Schedule may be increased

Amount of Increase

1. ( a ) For a single person or a person who is a widow or widower or a female person with a dependent husband where such person has one or more dependants (other than such husband) and, with the approval of the health board, a helper is employed to take care of such dependant or dependants.

£495 or the actual wage payable to the helper employed whichever is the lesser.

( b ) For a male person with a dependent wife where such person has one or more dependants ( other than such wife) and his wife is receiving in-patient services and, with the approval of the health board, a helper is employed to take care of such dependant or dependants.

£495 or the actual wage payable to the helper employed whichever is the lesser.

2. For each dependant ( other than a spouse)

£250.

3. For a person who is owner or tenant of the premises in which he ordinarily resides or who not being the owner or tenant pays or contributes substantially towards the payment of the outgoings of the premises in which he ordinarily resides.

£275 or the weekly amount of the outgoings or the amount of the weekly contribution towards the outgoings whichever is the lesser.

EXPLANATORY NOTE

The effect of these Regulations is to amend the existing Regulations governing the payment of maintenance allowances to persons being treated for certain infectious diseases—the Infectious Diseases (Maintenance) Regulations, 1975 ( S.I. No. 40 of 1975 )—to provide as from 1st October, 1975, for increases in the maximum rates of allowance payable.

The infectious diseases for which maintenance allowances are payable are tuberculosis, acute anterior poliomyelitis, typhoid, diphtheria, paratyphoid A, paratyphoid B, typhus fever, dysentery, salmonella infection, scarlet fever and streptococcal sore throat.
