DISEASES OF ANIMALS (NOTIFICATION OF INFECTIOUS DISEASES) ORDER, 1975.

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 , 12 , 13 and 27 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. This Order may be cited as the Diseases of Animals (Notification of Infectious Diseases) Order, 1975, and shall come into operation on the 15th day of August, 1975.

2. In this Order—

"animal", when used alone, means a porcine or equine animal;

"animal carcase" means the carcase of a porcine or equine animal and includes any part of such a carcase;

"disease", in relation to an animal or animal carcase, means any of the following diseases, namely, Teschen disease, Swine Influenza, Transmissible Gastro-Enteritis, African Horse Sickness, Dourine, Venezuelan Equine Encephalomyelitis, Infectious Equine Anaemia and, in relation to poultry or a poultry carcase, means Infectious Laryngo-Tracheitis or Arizona disease;

"diseased" means affected with a disease within the meaning of this Order;

"poultry", when used alone, means a bird of a kind specified in Part II of the First Schedule to the Diseases of Animals Act, 1966 (No. 6 of 1966) as amended by the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Orders, 1968 to 1972;

"poultry carcase" means the carcase of a bird so specified and includes any part of such a carcase.

3. Any person having in his possession or under his charge any animal, poultry, animal carcase or poultry carcase which is diseased, or which he suspects of being diseased, shall forthwith give notice thereof to—

( a ) the Secretary, Department of Agriculture and Fisheries, Dublin 2, or

( b ) the District Veterinary Office of the Department of Agriculture and Fisheries for the district in which the animal, poultry or carcase happens to be on the date of the notice.

4. Unless it is accompanied by, and is moved in accordance with conditions specified in, a permit issued for its movement by a veterinary inspector—

( a ) an animal or animal carcase which is diseased, which is suspected of being diseased, or which has been exposed, by contact or otherwise, to infection with a disease,

( b ) poultry, the eggs of poultry or a poultry carcase which is diseased, which is so suspected or which has been so exposed to infection with a disease,

( c ) eggs which are diseased, which are so suspected or which have been so exposed to infection with a disease,

shall not be moved out of the premises or other land on which it or they happen to be on the date of the relevant notice given pursuant to Article 3 of this Order.

EXPLANATORY NOTE.

The effect of this Order is that

( a ) any person having in his possession or under his charge any equine or porcine animal or carcase, poultry or poultry carcase or poultry eggs affected or suspected of being affected with any of the diseases specified in the Order or which have been in any way exposed to the infection concerned is required to notify the Secretary of the Department of Agriculture and Fisheries, Dublin 2, or the Department's nearest District Veterinary Office;

( b ) no equine or porcine animal or carcase, poultry or poultry carcase or poultry eggs affected or suspected of being affected with any of the diseases specified in the Order or which have been in any way exposed to the infection concerned may be moved except under a permit issued by a Veterinary Inspector of the Department.
