PRICES (STABILISATION OF PROFIT MARGINS OF RETAILERS OF MOTOR VEHICLES) ORDER, 1975.

I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 22C (inserted by the Prices (Amendment) Act, 1965 (No. 23 of 1965)), and section 22F (inserted by the Prices (Amendment) Act, 1972 (No. 20 of 1972) ) of the Prices Act, 1958 (No. 4 of 1958), hereby order as follows:

1. This Order may be cited as the Prices (Stabilisation of Profit Margins of Retailers of Motor Vehicles) Order, 1975.

2. This Order shall come into operation on the 28th day of April, 1975.

3. The amount in money by which the price at which a motor vehicle of any kind (other than a vehicle to which Article 4 or 5 of this Order applies) is sold in the course of business by any person engaged in trade or commerce, being a retailer of motor vehicles, exceeds the price at which that vehicle is bought by that person shall not exceed—

( a ) the amount by which the price at which a vehicle of that kind was sold in the course of business by that person on the 23rd day of June, 1973, or, if there was no such sale on the 23rd day of June, 1973, on the latest day before the 23rd day of June, 1973, on which there was such a sale, exceeded the price at which the last-mentioned vehicle was bought by that person, or

( b ) an amount equal to 13½ per cent. of the price at which the first-mentioned vehicle is recommended by its importer or assembler, as the case may be, to be sold by retail,

whichever is the greater.

4. The amount in money by which the price at which a motor vehicle of a kind that was not offered for sale by retail before the 24th day of June, 1973, is sold in the course of business by any person engaged in trade or commerce, being a retailer of motor vehicles, exceeds the price at which that vehicle is bought by that person shall not exceed—

( a ) the amount by which the price at which a vehicle of that kind was sold in the course of business by that person on the 24th day of April, 1975, or, if there was no such sale on the 24th day of April, 1975, on the latest day before the 24th day of April, 1975, on which there was such a sale, exceeded the price at which the last-mentioned vehicle was bought by that person, or

( b ) an amount equal to 13½ per cent. of the price at which the first-mentioned vehicle is recommended by its importer or assembler, as the case may be, to be sold by retail,

whichever is the greater.

5. The amount in money by which the price at which a motor vehicle of a kind that was not offered for sale by retail before the 24th day of April, 1975, is sold in the course of business by any person engaged in trade or commerce, being a retailer of motor vehicles, exceeds the price at which that vehicle is bought by that person shall not exceed an amount equal to 13½ per cent. of the price at which the vehicle is recommended by its importer or assembler, as the case may be, to be sold by retail.

6. The Schedule to the Prices (Stabilisation of Profit Margins of Retailers) Order, 1973 ( S.I. No. 168 of 1973 ) is hereby amended by the deletion of "Motor vehicles".

EXPLANATORY NOTE.

This Order fixes the maximum profit margins which may be taken by retailers of motor vehicles and amends the Prices (Stabilisation of Profit Margins of Retailers) Order, 1973.
