MINES AND QUARRIES (GENERAL REGISTER) REGULATIONS, 1974.

I, MICHAEL O'LEARY, Minister for Labour, in exercise of the powers conferred on me by section 127 of the Mines and Quarries Act, 1965 (No. 7 of 1965), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), and after due compliance with the provisions of that Act relating to the procedure for making general regulations, hereby make the following regulations:

1. These Regulations may be cited as the Mines and Quarries (General Register) Regulations, 1974.

2. These Regulations shall come into operation on the 1st day of July, 1974.

3. In these Regulations—

"the Act" means the Mines and Quarries Act, 1965 (No. 7 of 1965);

"doctor" means a registered medical practitioner;

"the Minister" means the Minister for Labour.

4. These Regulations shall apply to every mine and quarry.

5. The register required by section 111 (1) of the Act to be kept at the office of a mine or quarry, or at some other place approved by an inspector, shall be known as and is referred to in these Regulations as the general register and the general register shall contain the particulars mentioned in these Regulations and be in the form specified in the Schedule hereto.

6. The following particulars relating to every woman and young person employed at a mine or quarry shall be entered in or attached to the general register by the responsible person, namely:

( a ) the person's surname, Christian name and address;

( b ) the date of birth of the person;

( c ) the date of first employment of the person at the mine or quarry, as the case may be, and the date on which the person leaves such employment;

( d ) in case the person is a male young person and is employed below ground (in a mine) a record of the period for which he is so employed;

( e ) a certificate of fitness of the person for employment at a mine or quarry, as the case may be, signed by a doctor;

( f ) the date of issue of the certificate above-mentioned;

( g ) the medical examination reference number;

( h ) the name and address of the doctor; and

( i ) any conditions attached to the certificate above-mentioned.

7. Where an accident occurs at a mine or quarry, of which notice is required by section 98 (1) of the Act to be given to an inspector, the following particulars of the accident shall be entered in the general register by the responsible person, namely:

( a ) the date and place of the accident;

( b ) the date on which notice of the accident was given (on the appropriate form) to the inspector and the person (if any) nominated under the said section 98 (1);

( c ) the cause of accident (whether by explosives, falls of earth, machinery in motion or otherwise);

( d ) the name, sex and age of the person killed or injured;

( e ) the usual employment of such person;

( f ) the precise occupation of such person at the time of the accident;

( g ) the nature of the injury and whether fatal or not; and

( h ) the period of disablement (if applicable).

8. Where a case of disease occurs at a mine or quarry of which notice is required by virtue of an order made under section 100 (1) of the Act to be given to an inspector, the following particulars of the disease shall be entered in the general register by the responsible person, namely:

( a ) the date on which notice of the contraction of the disease was given (on the appropriate form) to the inspector and the person (if any) nominated under section 98 (1) of the Act;

( b ) the name, sex and age of the person affected;

( c ) the precise occupation of such person;

( d ) the notifiable disease to which the occurrence was due; and

( e ) such other remarks (if any) as the responsible person considers appropriate.

9. Where a dangerous occurrence occurs at a mine or quarry of which notice is required by virtue of an order made under section 99 (1) of the Act to be given to an inspector, the following particulars of the occurrence shall be entered in the general register by the responsible person, namely:

( a ) the date and place of the occurrence;

( b ) the date on which notice of the occurrence was given (on the appropriate form) to the inspector and the person (if any) nominated under section 98 (1) of the Act; and

( c ) the cause of the occurrence.

10. The following particulars relating to a workmen's inspector appointed pursuant to section 105 of the Act or a person nominated under section 98 (1) of the Act shall be entered in the general register by the responsible person, namely:

( a ) the name of such inspector or person so nominated and

( b ) the date of his appointment or nomination.

EXPLANATORY NOTE.

These regulations prescribe the particulars to be recorded in a register, known as the Mines and Quarries General Register, regarding the employment of women and young persons, the occurrence of accidents and other dangerous incidents and the contraction of certain industrial diseases. The regulations also require that a record be kept in the register of the names and dates of appointment of workmen's inspectors and persons nominated by employees to receive notices of accidents, dangerous occurrences and the outbreak of industrial diseases.
