FUELS (CONTROL OF SUPPLIES) (RESTRICTION ON DELIVERIES OF MOTOR SPIRIT) (AMENDMENT) ORDER, 1973.

The Minister for Transport and Power, in exercise of the powers conferred on him by section 3 of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971), hereby orders as follows:—

1. This Order may be cited as the Fuels (Control of Supplies) (Restriction on Deliveries of Motor Spirit) (Amendment) Order, 1973.

2. The Fuels (Control of Supplies) (Restriction on Deliveries of Motor Spirit) Order, 1973 ( S.I. No. 305 of 1973 ) is hereby amended—

( a ) by the substitution for paragraph (b) of Article 2 of the following paragraph:—

"( b ) where an oil retailer or commercial consumer—

(i) did not receive a supply of motor spirit before the 1st day of October, 1972, or

(ii) increased or decreased his business in the period from the 1st day of January, 1973, to the 30th day of September, 1973, by more than 12½ per cent when compared with the corresponding period in 1972.

such amount as shall be deemed appropriate by the Minister after consultation with the oil wholesaler or distributor concerned taking into account deliveries to comparable consumers in the six months ended on the 31st day of March, 1973."

( b ) by the substitution for Article 3 of the following Article:—

"3. In the period of four months ending on the 31st day of January, 1974, the amount of motor spirit delivered by an oil wholesaler or a distributor to an oil retailer or commercial consumer shall not exceed—

( a ) 58 per cent of normal deliveries in the case of a retailer,

( b ) 62½ per cent of normal deliveries in the case of a commercial consumer.".

EXPLANATORY NOTE.

This Order amends the Fuels (Control of Supplies) (Restriction on Deliveries of Motor Spirit) Order, 1973.

Paragraph 2 (b) sets out the maximum level of normal deliveries to be made by an oil wholesaler or distributor to a retailer or commercial consumer in the four month period up to 31st January, 1974.

Where a consumer received a supply of motor spirit before the 1st October, 1972 the amount received by him in the six months ending on the 31st of March, 1973, is considered his "normal delivery".

Where a consumer did not get a supply of motor spirit before 1st October, 1972, or where he increased or decreased his business in the period from the 1st January, 1973, to 30th September, 1973, by more than 12½% when compared with the corresponding period in 1972 his "normal delivery" shall be such as is deemed appropriate by the Minister after consultation with the oil wholesaler or distributor taking into account deliveries to comparable consumers in the six months ending on 31st March, 1973
