AIR NAVIGATION (EUROCONTROL) (ROUTE CHARGES) (AMENDMENT) (NO. 2) REGULATIONS, 1973.

I, PETER BARRY, Minister for Transport and Power, in exercise of the power conferred on me by section 12 of the Air Navigation (Eurocontrol) Act 1963 (No. 15 of 1963), as amended by section 1 of the Air Navigation (Eurocontrol) Act, 1971 (No. 19 of 1971), hereby make the following regulations (the charges thereunder having been determined by me in pursuance of tariffs approved of under an international agreement to which the State is a party):

1. (1) These Regulations may be cited as the Air Navigation (Eurocontrol) (Route Charges) (Amendment) (No. 2) Regulations, 1973, and shall come into operation on the 1st day of November, 1973.

(2) The collective citation "the Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971 to 1973", shall include these Regulations.

2. The Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971 ( S.I. No. 290 of 1971 ), as amended by the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1972 ( S.I. No. 59 of 1972 ), the Air Navigation (Eurocontrol) (Route Charges) (Amendment) (No. 2) Regulations, 1972 ( S.I. No. 160 of 1972 ), and the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1973 ( S.I. No. 214 of 1973 ), are hereby amended as follows:—

( a ) in Regulation 4, there shall be deleted: paragraph (2), paragraph (3), ",increased where appropriate in accordance with paragraph (2)," in paragraph (4) and ", increased where appropriate as aforesaid," in paragraph 5;

( b ) in paragraph (1) of Regulation 5, for "0.9899 United States dollars" there shall be substituted "2.3886 United States dollars";

( c ) in paragraph (5) of Regulation 5 "that most frequently used routes shall be revised by the Organisation annually, not later than the 1st day of November, so as to take account of modifications which may exist in the route or traffic structure and provided" shall be inserted after "Provided";

( d ) in the proviso to paragraph (6) of Regulation 5 for "six months" there shall be substituted "one year";

( e ) in paragraph (7) of Regulation 5, for "0.5816 United States dollars" there shall be substituted "1.2851 United States dollars" and for "0.9899 United States dollars" there shall be substituted "2.3886 United States dollars";

( f ) at the end of paragraph (d) of Regulation 7 there shall be added "between the aerodrome of departure and the aerodrome of first destination,";

( g ) for the Schedule there shall be substituted the Schedule set out in the Annex to these Regulations.

EXPLANATORY NOTE.

These Regulations provide for the amendment of existing charges to increase the rate of recovery of the cost of the provision of route facilities and services to 30 per cent. They also provide for the amendment of some existing charges to take account of the re-valuation of the Austrian Schilling and for some minor amendments of existing Regulations.
