BRUCELLOSIS IN CATTLE (CLEARANCE AREA) (GENERAL PROVISIONS) (AMENDMENT) ORDER, 1973.

I, MARK CLINTON, Minister for Agriculture and Fisheries, it appearing to me to be necessary for the purpose of the progressive eradication of brucellosis in cattle, do hereby, in exercise of the powers conferred on me by sections 3 , 20 and 48 of the Diseases of Animals Act, 1966 (No. 6 of 1966), order as follows:

1. (1) This Order may be cited as the Brucellosis in Cattle (Clearance Area) (General Provisions) (Amendment) Order, 1973.

(2) The Brucellosis in Cattle (Clearance Area) General Provisions Orders, 1966 to 1970, and this Order may be cited together as the Brucellosis in Cattle (Clearance Area) (General Provisions) Orders, 1966 to 1973.

(3) This Order shall come into operation on the 31st day of May, 1973.

2. The Brucellosis in Cattle (Clearance Area) (General Provisions) Order, 1966 ( S.I. No. 120 of 1966 ) is hereby amended by—

(a) the substitution in the definition of "approved ear-tag" in Article 2 of "Article 16" for "Article 15";

(b) the substitution in Article 16 (inserted by Article 2 of the Brucellosis in Cattle (Clearance Area) (General Provisions) (Amendment) Order, 1970 ( S.I. No. 136 of 1970 )) of the following paragraph for paragraph (2);

"(2) An inspector of the Minister or an authorised officer may apply, or cause to be applied, to an animal any mark which he considers necessary for the purpose of identification and the owner or person in charge of the animal shall permit the application of such mark.";

(c) the insertion in paragraph (3) of Article 16 after "No person other than" of "an inspector of the Minister,";

(d) the addition of the following paragraph to Article 16:

"(5) An inspector of the Minister, an authorised officer, or a veterinary surgeon authorised by the Minister to do so, may remove an approved ear-tag from a live animal and the owner or person in charge of the animal shall permit the removal and give such assistance as may be reasonably necessary for that purpose.";

(e) the substitution of the following for Article 18:

"18. The conditions specified in any approval, permission, permit, notice or licence given, issued or granted under or for the purposes of this Order shall be complied with.";

(f) the insertion of the following new Article after Article 18:

"19. Omission to carry out the requirements of any provision of this Order or of an approval, permission, permit, notice or licence given, issued or granted under or for the purposes of this Order shall be and is hereby declared to be an offence.".

EXPLANATORY NOTE.

This Order by amending the Brucellosis in Cattle (Clearance Area) (General Provisions) Order, 1966 makes additional provisions in relation to the ear-tagging of cattle in the Brucellosis Clearance Area
