PRICES AND CHARGES (NOTIFICATION OF INCREASES) ORDER, 1972.

I, PATRICK J. LALOR, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 22A (1) (b) of the Prices Act, 1958 (No. 4 of 1958), as amended by the Prices (Amendment) Act, 1965 (No. 23 of 1965) and the Prices (Amendment) Act, 1972 (No. 20 of 1972), hereby order as follows :

1. This Order may be cited as the Prices and Charges (Notification of Increases) Order, 1972.

2. This Order shall come into operation on the 1st day of November, 1972.

3. (a) Persons engaged in the importation of commodities and persons engaged in the sale by wholesale of commodities not manufactured by them shall notify the Minister of any increase they propose to make in the percentage by which the price (excluding Value Added Tax) at which they sell any commodity exceeds the price (excluding Value Added Tax) at which they purchase that commodity.

(b) Persons engaged in the manufacture of commodities, the rendering of services or the carrying out (other than under a contract of service) of work or a process shall notify the Minister of any increase they propose to make in the price at which they sell the commodities or the charges which they make for rendering the services or carrying out the work or process, as the case may be.

4. (a) A notification under paragraph 3 of this Order shall be given to the Minister not later than one month before the day on which the increase to which it relates takes effect.

(b) A notification given before the 1st day of November, 1972, in respect of any of the matters mentioned in the said paragraph 3 shall be deemed, for the purposes of this paragraph, to be a notification in respect of those matters under the said paragraph 3.

EXPLANATORY NOTE.

This Order provides that a manufacturer may not increase the price of a commodity manufactured by him, and that a person rendering a service or carrying out (other than under a contract of service) work or a process may not increase his charge without giving one month's notice in advance to the Minister for Industry and Commerce. The Order further provides that an importer or a wholesaler may not increase the margin he takes on any commodity in which he deals without giving one month's notice in advance to the Minister.
