SOCIAL WELFARE (OCCUPATIONAL INJURIES) (AMENDMENT) REGULATIONS, 1972.

I, JOSEPH BRENNAN, Minister for Social Welfare, in exercise of the powers conferred on me by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952), and section 1 of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966), hereby make the following Regulations :

1. (1) These Regulations may be cited as the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1972.

(2) These Regulations and the Social Welfare (Occupational Injuries) Regulations, 1967 to 1971, may be cited together as the Social Welfare (Occupational Injuries) Regulations, 1967 to 1972.

2. These Regulations shall come into operation on the 2nd day of October, 1972; provided that the amount of a disablement gratuity as provided by Article 6 of these Regulations shall be payable only when the period taken into account by the assessment of the degree of disablement begins on or after the 2nd day of October, 1972.

3. In these Regulations " the Principal Regulations " means the Social Welfare (Occupational Injuries) Regulations, 1967 ( S.I. No. 77 of 1967 );

" the regulations of 1971 " means the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1971 ( S.I. No. 232 of 1971 ).

4. In Article 4 (2) (a) of the Principal Regulations " six pounds and ten new pence " is hereby substituted for " five pounds and fifty new pence " (inserted by the regulations of 1971) and in Article 4 (2) (b) of the Principal Regulations " two pounds and forty-six new pence " is hereby substituted for " one pound and eighty-seven new pence " (inserted by the regulations of 1971).

5. In Article 9 (a) of the Principal Regulations " three pounds ", " one pound and sixty-five new pence ", and " three pounds and sixty-five new pence ", are hereby substituted for, respectively, " two pounds and seventy-five new pence ", " one pound and thirty-eight new pence " and " three pounds and forty new pence " (inserted by the regulations of 1971).

6. (1) The scale set out in the Schedule to these Regulations is hereby substituted for the scale (inserted by the regulations of 1971) set out in the Second Schedule to the Principal Regulations.

(2) The weekly rate of pension set out in column (3) of the scale set out in the Schedule to these Regulations shall have effect on and from the 2nd day of October, 1972, whether the period taken into account by the assessment began on or before or after that date.

EXPLANATORY NOTE.

Consequent on increases in standard weekly rates of occupational injuries benefits effected by the Social Welfare Act, 1972 , these Regulations amend the Social Welfare (Occupational Injuries) Regulations 1967 ( S.I. No. 77 of 1967 ) for the purpose of increasing rates of injury benefit payable to persons under age sixteen, amounts of disablement gratuities (and rates of pension which may be substituted therefor) appropriate to degrees of disablement below 20% and rates of constant attendance allowance.
