MERCHANDISE MARKS (RESTRICTION ON IMPORTATION OF LEAD ACID ACCUMULATORS) ORDER, 1972.

I, PATRICK J. LALOR, Minister for Industry and Commerce, having considered a report of the Merchandise Marks Commission under section 7 of the Merchandise Marks Act, 1931 (No. 48 of 1931), on an application for a restriction on importation order in relation to goods of a description specified in paragraph 4 of this Order, and having complied with section 14 of that Act, hereby, in exercise of the powers conferred on me by section 8 of that Act (as amended by section 7 of the Merchandise Marks Act, 1970 (No. 10 of 1970)), order as follows—

1. This Order may be cited as the Merchandise Marks (Restriction on Importation of Lead Acid Accumulators) Order, 1972.

2. This Order shall come into operation on the 1st day of October, 1972.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. Subject to paragraph 6 of this Order, the importation by way of trade into the state of lead acid accumulators assembled complete with lid, whether sealed or not, is hereby prohibited unless they bear at importation an indication of origin consisting of the words "Made in" or other words in English denoting manufacture followed by the name in English of the country in which the goods were manufactured.

5. An indication of origin borne by an accumulator pursuant to this Order shall be legible and conspicuous and shall be—

(a) embossed, engraved or otherwise indelibly marked on the side or top of the accumulator, or

(b) marked indelibly on a durable label which is securely affixed by a permanent adhesive to the side or top of the accumulator.

6. This Order shall not apply to:—

(a) lead acid accumulators—

(i) which are imported as component parts of complete or substantially complete articles, or

(ii) of which the length does not exceed one hundred and forty-six millimetres, the width does not exceed one hundred and fifteen millimetres and the height does not exceed one hundred and ninety-one millimetres, and

(b) goods to which section 37 of the Finance Act, 1932 (No. 20 of 1932), section 18 of the Finance Act, 1938 (No. 25 of 1938) or section 18 of the Finance Act, 1946 (No. 15 of 1946), applies.

EXPLANATORY NOTE.

The Order prohibits the importation of lead acid accumulators assembled complete with lid, whether sealed or not, unless they bear at importation an indication of the country of origin. It does not apply to accumulators imported as component parts of complete or substantially complete goods, articles designed for use by blind persons or articles for international airports or ship building yards.
