FACTORIES ACT, 1955 (EXTENSION OF DEFINITION OF "WORK OF ENGINEERING CONSTRUCTION") REGULATIONS, 1972.

I, JOSEPH BRENNAN, Minister for Labour, in exercise of the powers conferred on me by sections 2 (1) and 6 of the Factories Act, 1955 (No. 10 of 1955), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), hereby make the following Regulations:

1. These Regulations may be cited as the Factories Act, 1955 (Extension of Definition of "Work of Engineering Construction") Regulations, 1972.

2. These Regulations shall come into operation on the 1st day of May, 1972.

3. In these Regulations—

"the Act" means the Factories Act, 1955 (No. 10 of 1955);

"repair" includes re-pointing and re-painting.

4. (1) In the Act the definition of "work of engineering construction" shall include the works mentioned in paragraph (2) of this regulation.

(2) Subject to paragraph (3) of this regulation, the works referred to in paragraph (1) of this regulation, are:

(a) the construction, structural alteration or the repair or demolition of any of the following—

(i) a steel or reinforced concrete structure or a similar structure,

(ii) a road,

(iii) an airfield,

(iv) any sea defence works or river works,

(v) any other works which are similar to any of the foregoing, and

(b) the construction (whether by laying or otherwise) the structural alteration or the repair or demolition of any of the following—

(i) a pipe-line for conveying any solid, liquid or gas,

(ii) an underground electricity or telecommunications cable system.

(3) The works mentioned in paragraph (2) of this regulation include neither a building operation nor works carried out —

(a) in a factory or on premises to which the Act applies by virtue of section 83 (1) thereof, or

(b) upon a railway or tramway.

EXPLANATORY NOTE.

The purpose of these regulations is to extend the definition of "work of engineering construction" in the Factories Act, 1955 , to include various other works not already included in that definition.
