SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) REGULATIONS, 1972.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 7 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Contributions) (Amendment) Regulations, 1972.

(2) The Social Welfare (Contributions) Regulations, 1953 to 1971, and these Regulations may be cited collectively as the Social Welfare (Contributions) Regulations, 1953 to 1972.

2. (1) Where by virtue of the provisions of the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1971 ( S.I. No. 315 of 1971 ) an insured person becomes an employed contributor or in the case of a person who is already an employed contributor by virtue only of section 36 (1) of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966), an employed contributor liable for contributions at the ordinary rate then, subject to sub-article (2) of this article, the insured person, being a man, shall be credited with employment contributions in respect of the period which commenced on the 5th day of January, 1970 and which ended on the 29th November, 1971 or, being a woman, shall be credited with employment contributions in respect of the period which commenced on the 6th day of July, 1970 and which ended on the 29th November, 1971.

(2) An insured person shall not be credited under sub-article (1) of this article with an employment contribution in respect of any contribution week for which an employment contribution, reckonable for the purposes of benefits including unemployment benefit, has been paid or credited in respect of him.

EXPLANATORY NOTE.

These Regulations provide for the crediting of employment contributions to sick or disabled persons employed by local or public authorities who were formerly exempt from insurance (except for occupational injuries benefit) by the operation of a provision deleted by the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1971 (No. 315 of 1971). The credited contributions which will reckon for all benefits under the Social Welfare Acts will be granted for a period sufficient to enable such persons to satisfy the statutory conditions requiring them to have a specified number of employment contributions paid or credited in respect of them in the contribution year immediately prior to the current benefit year.
