SOCIAL WELFARE (DEATH GRANT) REGULATIONS, 1971.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 28B of the said Act (inserted therein by section 10 of the Social Welfare Act, 1970 (No. 12 of 1970)), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Death Grant) Regulations, 1971.

2. In these Regulations—

"the Act of 1952" means the Social Welfare Act, 1952 ;

"the Act of 1970" means the Social Welfare Act, 1970 ;

"relevant insured person" means relevant insured person as defined in paragraph 7 of the Fourth Schedule to the Act of 1952 (added thereto by section 18 of the Act of 1970) and "relevant contribution year or years" means the contribution year referred to in sub-paragraph (b) (i) of paragraph 7 of the said Fourth Schedule or the period over which the average per contribution year may be calculated under sub-paragraph (b) (ii) of the said paragraph 7, as the case may be.

3. Where a person would be entitled to a death grant but for the fact that the contribution conditions contained in sub-paragraph (b) of paragraph 7 of the Fourth Schedule to the Act of 1952 as respects the number, or the average number per year, as the case may be, of contributions paid or credited, are not satisfied, the following provisions shall apply:—

(a) where the number, or the average number per year, of contributions paid in respect of or credited to the relevant insured person in the relevant contribution year or years, as the case may be, is not less than twenty-six, a death grant shall be payable,

(b) where the number, or the average number per year, of such contributions is less than forty-eight but not less than twenty-six, fractions of whole numbers being disregarded, a death grant shall be payable at the appropriate rate set forth in the Schedule hereto.

EXPLANATORY NOTE.

These Regulations provide for the payment of reduced rates of death grant where the contribution conditions are only partially satisfied. The reduced rates payable and the number of contributions applicable are set out in the Schedule to the Regulations.
