MINES AND QUARRIES (NOTIFICATION OF DISEASES) ORDER, 1971

I, JOSEPH BRENNAN, Minister for Labour, in exercise of the powers conferred on me by section 100 (1) of the Mines and Quarries Act, 1965 (No. 7 of 1965) and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), hereby order as follows:

1. This Order may be cited as the Mines and Quarries (Notification of Diseases) Order, 1971.

2. This Order shall come into operation on the 15th day of March, 1971.

3. In this Order "the section" means section 98 of the Mines and Quarries Act, 1965 (No. 7 of 1965).

4. The provisions of the section are hereby applied to the contraction by a person, employed at a mine or quarry, of a disease specified in the First Schedule to this Order.

5. The notice of the contraction by a person of a disease specified in the First Schedule to this Order and required by virtue of this Order and the section to be given by the responsible person in the manner specified in the section shall be in the form and shall contain the particulars specified in the Second Schedule to this Order.

FIRST SCHEDULE.

1. Poisoning or incapacity by—

(a) aluminium,

(b) antimony,

(c) arsenic,

(d) cadmium,

(e) copper,

(f) lead,

(g) manganese,

(h) mercury,

(i) silver,

(j) zinc,

(k) any other mineral of a toxic nature,

(l) a compound of any of the foregoing,

(m) asbestos,

(n) cyanide, or

(o) nitrous fumes.

2. Ankylostomiasis; anthracosis; bursitis or subcutaneous cellulitis arising at or about the elbow, hand or knee (beat elbow, beat hand or beat knee); compressed air illness (caisson disease); dermatitis; infective jaundice; nystagmus; pneumoconiosis; silicosis.

EXPLANATORY NOTE.

This Order provides that where a person employed at a mine or quarry contracts a disease specified in the First Schedule to the Order, notification shall be given to an inspector for the purposes of the Mines and Quarries Act, 1965 and to such person as may be nominated by the body or bodies representative of a majority of the persons employed. In addition, the Order prescribes the form of notice to be used for this purpose and the particulars to be contained in the notice.
