LIVE STOCK (BOARS) BREEDING (AMENDMENT) REGULATIONS, 1970.

I, JAMES GIBBONS, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 20 (1) of the Live Stock Breeding Act, 1925 (No. 3 of 1925), and the Live Stock Breeding Act, 1925 (Application to Boars) Order, 1930 (S. R. and 0., No. 70 of 1930), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1965 ( S.I. No. 146 of 1965 ), hereby, with the consent of the Minister for Finance (in so far as the following regulations provide for the fixing of fees), make the following regulations:

1. (1) These Regulations may be cited as the Live Stock (Boars) Breeding (Amendment) Regulations, 1970.

(2) These Regulations shall come into operation on the 1st day of December, 1970.

(3) The Regulations of 1930 and these Regulations may be cited together as the Live Stock (Boars) Breeding Regulations, 1930 and 1970.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to these Regulations.

3. In these Regulations "the Regulations of 1930" means the Live Stock (Boars) Breeding Regulations, 1930 (S. R. and 0., No. 71 of 1930).

4. (1) Subject to paragraph (2) of this regulation, the Regulations of 1930 shall be amended—

( a ) by the substitution for Regulation 4 of the following:

"4. The age at which the Act shall apply to boars born on or after the 1st day of July, 1970, shall be seven months (which age is in these Regulations referred to as the prescribed age)";

( b ) by the substitution for Regulation 5 (1) of the following:

"(1). An application for a licence to keep a boar shall be in, or in a form substantially similar to, the form set out at (A) in the Schedule to these Regulations and, subject to section 2 (3) of the Act, shall be made to the Minister—

( a ) in the case of a boar which was farrowed in July, 1970, not later than the 31st day of December, 1970, or

( b ) in the case of any other boar, not later than the day on which the boar to which the application relates attains the age of five months.";

( c ) by the substitution of "two shillings" for "two shillings and sixpence" in Regulation 5 (2);

( d ) by the substitution for Regulation 5 (3) of the following:

"(3). In case an application for the grant of a licence under section 2 of the Act in relation to a boar is made at a time other than that mentioned in paragraph (1) of this regulation, an additional fee of one pound shall be payable in respect of the application.";

( e ) by the substitution of "two shillings" for "two shillings and sixpence" in Regulation 9 (2);

( f ) by the substitution of "two shillings" for "2s. 6d." in in the form set out at (A) in the Schedule ; and

( g ) by the substitution of "two shillings" for "two shillings and sixpence " in the form set out at (B) in the Schedule.

(2) ( a ) For the purposes of Regulation 5 (1) of the Regulations of 1930 (inserted by paragraph (1) (b) of this regulation), a boar farrowed before the 1st day of July, 1970, shall be deemed to have attained the age of five months on the day on which these Regulations come into operation.

( b ) The Regulations of 1930 shall, in relation to a boar farrowed before the 1st day of July, 1970, be construed and have effect as if paragraph (1) (a) of this regulation had not been mde.

EXPLANATORY NOTE

These Regulations, which come into operation on 1st December, 1970, amend the Live Stock (Boars) Breeding Regulations, 1930. The principal changes are:—

(1) the prescribed age at which a boar must be licensed is the age of seven months;

(2) the latest date for making application to the Minister for a boar licence is the date on which the boar attains the age of five months;

(3) the fee for a boar licence is two shillings (equivalent to 10p from Decimal Day);

(4) the additional fee payable with every late application for a boar licence is one pound;

(5) the fee for a permit to fatten a boar for slaughter is two shillings.
