ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) (No. 3) REGULATIONS, 1970.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 82 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) (No. 3) Regulations, 1970.

(2) The Road Traffic (Public Service Vehicles) Regulations, 1963 to 1970 and these Regulations shall be construed as one.

(3) The collective citation "the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1970" shall include these Regulations.

(4) In these Regulations "the Principal Regulations" means the Road Traffic (Public Service Vehicles) Regulations, 1963 ( S.I. No. 191 of 1963 ).

(5) A reference in these Regulations to a provision of the Principal Regulations shall be construed as a reference to that provision as amended by the Road Traffic (Public Service Vehicles) (Amendment) Regulations, 1968, S.I. No. 273 of 1968 , and the Road Traffic (Public Service Vehicles) (Amendment) (No. 2) Regulations, 1970 ( S.I. No. 200 of 1970 ).

2. The Principal Regulations are hereby amended as follows:—

( a ) The following sub-article shall be substituted for sub-article (4) of article 20:—

"(4) A small public service vehicle licence shall not be granted in respect of a vehicle the date of manufacture or of first registration of which is more than two years from the date of the application for the licence unless—

( a ) the application is made by a person who at anytime between 1st September, 1968, and 1st September, 1970, held a licence granted under this article in respect of a vehicle, and

( b ) the application is made for the purpose of licensing the said vehicle, or

( c ) the application is made for the purpose of licensing another vehicle to replace the said vehicle and the licence in respect of the said vehicle has expired or shall have been surrendered or revoked on or before the grant of the licence for which application is made."

( b ) In paragraph (b) (iv) of sub-article (1) of article 31 "at anytime between 1st September, 1968, and 1st September, 1970 held a licence granted under article 20 of these Regulations" shall be substituted for "during the whole of the period from the date of these Regulations to the date of such application held a valid licence" and "licensed as a small public service vehicle" shall be substituted for "so licensed" wherever it occurs.

( c ) In paragraph (b) of sub-article (2) of article 34 "at anytime between 1st September, 1968 and 1st September, 1970 held a licence granted under this article" shall be substituted for "during the whole of the period from the date of these Regulations to the date of the application was the holder of a valid licence."

( d ) In paragraph (c) of sub-article (3) of article 34 "at anytime between 1st September, 1968 and 1st September, 1970 was the holder of a licence granted under this article" shall be substituted for "during the whole of the period from the date of these Regulations to the date of the application was the holder of a valid licence."

( e ) In sub-article (2) of article 41 "at anytime between 1st September, 1968, and 1st September, 1970 held a licence granted under article 34 of these Regulations" shall be substituted for "during the whole of the period from the date of these Regulations to the date of his application held a valid such licence."

EXPLANATORY NOTE.

These Regulations enable those who held small public service vehicle or drivers' licences at anytime between 1st September, 1968, and 1st September, 1970 to apply for a renewal of such licences on conditions similar to those which apply to holders of such licences on 27th August, 1970. The Regulations also apply like conditions to operators changing licences for vehicles (or their replacements), already licensed as small public service vehicles, from one category of small public service vehicle licence to another.
