HARBOUR RATES (TRALEE AND FENIT PIER AND HARBOUR) ORDER, 1970.

I, BRIAN LENIHAN, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and after due compliance with section 106 of the said Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Tralee and Fenit Pier and Harbour) Order, 1970.

(2) This Order shall come into operation on the 1st day of May, 1970.

2. (1) The rates set out in column (3) of the Table to this Article at any reference number are hereby fixed as the maximum rates to be charged by the Tralee and Fenit Pier and Harbour Commissioners for the use at Fenit Pier of a crane of the kind specified in the Part of the Table in which that reference number occurs for the lifting of goods or articles of the kind specified in column (2) of the Table at that reference number.

(2) In the Table to this Article—

"overtime" means any time on Sundays or days which are public holidays for the purposes of the Holidays (Employees) Act, 1961 (No. 33 of 1961), for employees of the Tralee and Fenit Pier and Harbour Commissioners, any time after midday on Saturdays and any time between midnight and 8 a.m. and 5 p.m. and midnight on any other day;

"normal time" means time that is not overtime.

3. The Harbour Rates (Tralee and Fenit Pier and Harbour) Order, 1954 ( S.I. No. 266 of 1954 ), is hereby amended by the deletion in the Third Schedule of the matter at reference number 7.

EXPLANATORY NOTE.

The effect of this Order is to authorise the Tralee and Fenit Pier and Harbour Commissioners to charge revised cranage rates.
