PUBLIC ASSISTANCE (FOOTWEAR REGULATIONS) (AMENDMENT) ORDER, 1970.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 5 and subsection (2) of section 39 of the Public Assistance Act, 1939 , as adapted by the Social Welfare (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1947 (S.R. and O. 1947 No. 329) by this his Order makes the following Regulations:—

1. These Regulations may be cited as the Public Assistance (Footwear Regulations) (Amendment) Order, 1970.

2. (1) In these Regulations "the Principal Regulations" means the Public Assistance (Footwear Regulations) Order, 1944 (S.R. and O. 1944 No. 339).

(2) These Regulations and the Principal Regulations shall be construed as one and may be cited as the Public Assistance (Footwear Regulations) Orders, 1944 and 1970.

3. (1) A footwear voucher issued under the Principal Regulations may, if the public assistance authority are satisfied that official footwear is difficult to obtain locally, be exchanged for boots or shoes which are not official footwear.

(2) In respect of footwear other than official footwear the following provisions shall apply:—

(a) The footwear supplied shall be of good quality and suitable for the child named in the voucher.

(b) The contribution to be paid by the public assistance authority towards the cost of the footwear shall be

(i) the same as if official footwear were supplied, or

(ii) the retail cost of the footwear supplied reduced by the amount the recipient would have been required to contribute had official footwear been supplied,

whichever is the less.

(c) Articles 8, 9, 10 and 12 of the Principal Regulations shall apply to a footwear voucher issued in accordance with these Regulations in like manner as they apply to a footwear voucher issued under the Principal Regulations.

EXPLANATORY NOTE.

The Public Assistance Footwear Scheme provided for the issue of official footwear in return for vouchers issued by Public Assistance Authorities. This Regulation authorises the issue of other types of footwear in return for vouchers where official footwear is difficult to obtain.
