MEDICAL PREPARATIONS (CONTROL OF AMPHETAMINE) REGULATIONS, 1969.

The Minister for Health, in exercise of the powers conferred on him by sections 5 and 65 of the Health Act, 1947 (No. 28 of 1947), as amended by section 39 of the Health Act, 1953 (No. 26 of 1953), hereby makes the following Regulations :—

1. These Regulations may be cited as the Medical Preparations (Control of Amphetamine) Regulations, 1969.

2. In these Regulation—

" the Minister " means the Minister for Health;

" controlled preparation " means any of the substances specified in the Schedule to these Regulations and any preparation containing such a substance;

" sale " includes offering or keeping for sale.

3. (1) These Regulations, except article 5, shall come into operation on 10th December, 1969.

(2) Article 5 of these Regulations shall come into operation on the 19th January, 1970.

4. No person shall manufacture, prepare or import a controlled preparation save in accordance with the provisions of article 7 of these Regulations.

5. No person shall distribute or sell a controlled preparation save in accordance with the provisions of articles 6 or 7 of these Regulations.

6. During the period 19th January, 1970 to 16th February, 1970 a controlled preparation may be sold or distributed so as to permit a person having a stock of a controlled preparation in his possession to dispose of such stock in such manner as the Minister may specify or approve.

7. (a) The Minister may, on application being made to him in accordance with such conditions as he may specify, grant a licence permitting the manufacture, import, preparation, distribution or sale of a controlled preparation where the conditions of such licence are complied with.

(b) The conditions attaching to a licence may in particular require that :

(i) the amount of the controlled preparation specified in the licence is not exceeded;

(ii) the controlled preparation is manufactured, imported, prepared, distributed or sold within the time specified in such licence.

8. Nothing in these Regulations shall be construed as permitting the sale by retail of a controlled preparation in contravention of the Medical Preparations (Control of Sale) Regulations, 1966 ( S.I. No. 261 of 1966 ).

9. These Regulations shall be enforced and executed by health authorities and their officers and by officers of Customs and Excise and they may also be enforced by officers of the Minister.

SCHEDULE.

(i) α —Methylphenethylamine

(ii) β —Methylphenethylamine

(iii) α —Ethylphenethylamine

(iv) Any synthetic compound structurally derived from any of these substances by substitution in the aliphatic part or by ring closure therein (or by both such substitution and such closure) except ambutonium bromide, ephedrine, its optical isomers and N-substituted derivatives, diethylpropion, mephentermine, methylphenidate, oxethazine, phenylpropanolamine, prenylamine, tranylcypromine and tropicarnide.

(v) Chlorphentermine

(vi) Pemoline

(vii) Any salt of any of the substances specified in paragraphs (i), (ii) or (iii) above, or of a compound falling within paragraph (iv) above, or of either of the substances specified in paragraphs (v) and (vi) above.

(viii) Any substance containing any proportion of any of the substances specified in paragraphs (i), (ii) or (iii) above, or of a compound falling within paragraph (iv) above or of either of the substances specified in paragraphs (v) and (vi) above or of such a salt as is mentioned in paragraph (vii) above.

The Minister for Finance hereby consents to the enforcement and execution of articles 4 and 7 of the above Regulations (in so far as they relate to importation) by officers of Customs and Excise.

EXPLANATORY NOTE.

The Regulations prohibit, as from 10th December, 1969 the manufacture, preparation and importation of the drugs listed in the Schedule—amphetamines, their derivatives and preparations containing such substances. The Regulations also prohibit as from 19th January, 1970 the sale or distribution of these drugs, derivatives and preparations.

Provision is made in article 6 to permit the disposal of unused stocks of the substances to which the Regulations apply held by manufacturers and wholesale and retail chemists.

There is also provision for the granting by the Minister at any time of a licence for the manufacture, preparation, importation, distribution, or sale of any of the said substances.
