SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) REGULATIONS, 1969.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 7 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes the following Regulations—

1. (1) These Regulations may be cited as the Social Welfare (Contributions) (Amendment) Regulations, 1969.

(2) The Social Welfare (Contributions) Regulations, 1953 to 1968, and these Regulations may be cited collectively as the Social Welfare (Contributions) Regulations, 1953 to 1969.

2. The Social Welfare (Contributions) Regulations, 1953 ( S.I. No. 5 of 1953 ) are hereby amended by the insertion after article 10C (inserted by the Social Welfare (Contributions) (Amendment) Regulations, 1968 ( S.I. No. 1 of 1968 ) ) of the following article—

" 10D—(1) In this article " reservist " means an officer or man of the Reserve Defence Force called out in aid of the civil power.

(2) The Minister for Defence shall not be liable to pay in respect of a reservist any employment contribution for the whole or part of any contribution week commencing on or after the 11th day of August, 1969, during which the said reservist is in employment as a member of the Defence Forces except in the case of a contribution which would, but for this article, be payable and which is necessary to establish an entitlement under the Act, in which case the contribution shall be treated as paid on the due date, notwithstanding any other provisions of these Regulations.

(3) An employment contribution shall be credited to a reservist for any contribution week commencing on or after the 11th day of August, 1969, during the whole or any part of which he is in employment as a member of the Defence Forces where an employment contribution is not payable in respect of him for that week."

EXPLANATORY NOTE.

These Regulations amend the Social Welfare (Contributions) Regulations, 1953 to 1968, so as to provide that, in certain circumstances, the Minister for Defence shall be excepted from liability to pay employment contributions in respect of reservists called out in aid of the civil power. The Regulations also provide for the crediting of employment contributions to such reservists where employment contributions are not payable.
