ARMY PENSIONS (INCREASE) REGULATIONS, 1969.

I, SÉAMUS MAC GIOBÚIN, Minister for Defence, in exercise of the powers conferred on me by section 7 of the Army Pensions Act, 1968 (No. 12 of 1968), and with the consent of the Minister for Finance, hereby make the following Regulations :

PART I. PRELIMINARY

1 Short Title

1. These Regulations may be cited as the Army Pensions (Increase) Short Title. Regulations, 1969.

2 Definitions

2. (1) In these Regulations Definitions. Interpretation

Interpretation

1923, No. 26.

" the Act of 1923 " means the Army Pensions Act, 1923 ;

1927, No. 12.

" the Act of 1927 " means the Army Pensions Act, 1927 ;

1932, No. 24.

" the Act of 1932 " means the Army Pensions Act, 1932 ;

1937, No. 15.

" the Act of 1937 " means the Army Pensions Act, 1937 ;

1941, No. 2.

" the Act of 1941 " means the Army Pensions Act, 1941 ;

1943, No. 14.

" the Act of 1943 " means the Army Pensions Act, 1943 ;

1946, No. 3.

" the Act of 1946 " means the Army Pensions Act, 1946 ;

1949, No. 19.

" the Act of 1949 " means the Army Pensions Act, 1949 ;

1953, No. 23.

" the Act of 1953 " means the Army Pensions Act, 1953 ;

1960, No. 39.

" the No. 2 Act of 1960 " means the Army Pensions (No. 2) Act, 1960 ;

1962, No. 22.

" the Act of 1962 " means the Army Pensions Act, 1962 ;

1964, No 27.

" the Increase Act of 1964 " means the Army Pensions (Increase) Act, 1964 ;

" the Acts " means the Army Pensions Acts, 1923 to 1968,

" the April, 1922—September, 1924, period " means the period which commenced on the 1st day of April, 1922, and ended on the 30th day of September, 1924.

(2) These Regulations shall be construed as one with the Acts.

(3) References in these Regulations to any enactment shall be construed as references to that enactment as amended by any subsequent enactment.

PART II. PENSIONS AND ALLOWANCES, INCLUDING SPECIAL ALLOWANCES, PAYABLE UNDER THE ARMY PENSIONS ACTS, 1923 TO 1968.

3 Increase of wound, disability, further and married pensions granted under sections 1, 2 and 3 of the Act of 1923 and sections 9, 11 and 13 of the Act of 1927, to officers discharged from the forces before the 1st day of October, 1924, and to persons ranking as officers

3. (1) This paragraph applies to—

(a) wound pensions granted under section 1 of the Act of 1923 to officers discharged from the forces before the 1st day of October, 1924 and to further pensions granted to such officers under section 2 of that Act,

(b) wound pensions and further pensions granted under section 3 of the Act of 1923 to persons ranking as officers,

(c) disability and married pensions granted under section 9 of the Act of 1927 to officers,

(d) wound and married pensions granted under section 11 of the Act of 1927 to officers,

(e) disability and married pensions granted under section 13 of the Act of 1927 to officers discharged from the forces before the 1st day of October, 1924, and

(f) disability and married pensions granted under section 13 of the Act of 1927 to persons ranking as officers.

(2) (a) A wound or disability pension to which this paragraph applies shall—

(i) with effect from the 1st day of October, 1964, be payable at the increased rate mentioned in column (2) of Table I to this paragraph, and

(ii) with effect from the 1st day of August, 1965, be payable at the increased rate mentioned in column (4) of that Table,

being (in each case) a rate opposite to the appropriate degree of disablement mentioned in column (1) of that Table.

(b) A wound or disability pension to which this paragraph applies shall—

(i) with effect from the 1st day of August, 1967, be payable at the increased rate mentioned in column (2) of Table II to this Paragraph, and

(ii) with effect from the 1st day of August, 1968, be payable at the increased rate mentioned in column (4) of that Table,

being (in each case) a rate opposite to the appropriate degree of disablement mentioned in column (1) of that Table.

(3) (a) A further or married pension to which this paragraph applies shall—

(i) with effect from the 1st day of October, 1964, be payable at the increased rate mentioned in column (3) of Table I to this paragraph, and

(ii) with effect from the 1st day of August, 1965, be payable at the increased rate mentioned in column (5) of that Table,

being (in each case) a rate opposite to the appropriate degree of disablement mentioned in column (1) of that Table.

(b) A further or married pension to which this paragraph applies shall—

(i) with effect from the 1st day of August, 1967, be payable at the increased rate mentioned in column (3) of Table II to this paragraph, and

(ii) with effect from the 1st day of August, 1968, be payable at the increased rate mentioned in column (5) of that Table,

being (in each case) a rate opposite to the appropriate degree of disablement mentioned in column (1) of that Table.

4 Increase of wound pensions to certain officers under Section 1 of the Act of 1923 and of wound and disability pensions to officers under sections 10, 12 and 13(1)(b) of the Act of 1927

4. (1) This paragraph applies to—

(a) a wound pension granted under section 1 of the Act of 1923 to an officer discharged from the forces on or after the 1st day of October, 1924, and before the 2nd day of January, 1964,

(b) a disability pension granted under section 10 (1) of the Act of 1927 to an officer discharged from the forces before the 2nd day of January, 1964, who, at the date of his discharge, was suffering from a disablement caused by disease attributable to service in the forces during the April, 1922—September, 1924 period, to service in the forces during the emergency period, or to service with a United Nations Force,

(c) a wound pension granted under section 12 (1) of the Act of 1927 to an officer discharged from the forces before the 2nd day of January, 1964 and

(d) a disability pension granted under section 13 (1) of the Act of 1927 to an officer discharged from the forces on or after the 1st day of October, 1924, and before the 2nd day of January, 1964.

(2) A wound or disability pension to which this paragraph applies shall be increased as follows:—

(a) in the case of an officer discharged from the forces before the 2nd day of February, 1961—

(i) by five per cent with effect from the 1st day of October, 1964,

(ii) with effect from the 1st day of August, 1965, to an amount equal to the amount payable to such officer under the Acts on the 30th day of September, 1964, increased by fourteen and one-half per cent,

(iii) by an additional twelve per cent with effect from the 1st day of August, 1967 and

(iv) by an additional five per cent with effect from the 1st day of August, 1968;

(b) in the case of an officer discharged from the forces on or after the 2nd day of February, 1961 and before the 2nd day of November, 1961—

(i) by five per cent with effect from the 1st day of October, 1964,

(ii) with effect from the 1st day of August, 1965 to an amount equal to the pension which would be payable to such officer under the Acts if the date of his discharge had been the 16th day of December, 1959, and his rank and service in that rank on that date were the same as those on the date of his actual discharge, increased by fourteen and one-half per cent,

(iii) by an additional twelve per cent with effect from the 1st day of August, 1967, and

(iv) by an additional five per cent with effect from the 1st day of August, 1968;

(c) in the case of an officer discharged from the forces on or after the 2nd day of November, 1961—

(i) by nine per cent with effect from the 1st day of August, 1965,

(ii) by an additional twelve per cent with effect from the 1st day of August, 1967, and

(iii) by an additional five per cent with effect from the 1st day of August, 1968.

(3) In respect of the period from the 1st day of October, 1964, to the 31st day of July, 1965, this paragraph shall not apply to an officer who was discharged from the forces on the 18th day of December, 1954.

5 Increase of wound and disability pensions to soldiers

5. (1) This paragraph applies to—

(a) wound pensions granted under section 1 of the Act of 1923 to soldiers;

(b) wound pensions granted under section 3 of the Act of 1923 to persons ranking as soldiers;

(c) disability pensions granted under section 9 of the Act of 1927 to soldiers;

(d) disability pensions granted under section 10 of the Act of 1927 to soldiers suffering from disablement caused by disease attributable to service during the April, 1922—September, 1924, period;

(e) disability pensions granted under section 10 of the Act of 1927 to soldiers in respect of disablement caused by disease attributable to service in the forces during the emergency period;

(f) disability pensions granted under section 10 of the Act of 1927 to soldiers in respect of disablement caused by disease attributable to service with a United Nations Force;

(g) wound pensions granted under section 11 of the Act of 1927 to soldiers;

(h) wound pensions granted under section 12 of the Act of 1927 to soldiers;

(i) disability pensions granted under section 13 of the Act of 1927 to soldiers;

(j) disability pensions granted under section 13 of the Act of 1927 to persons ranking as soldiers.

(2) A wound or disability pension to which this paragraph applies shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rates mentioned in columns (2), (3), (4) and (5) respectively of the Table to this paragraph corresponding to the degree of disablement mentioned in column (1) of that Table.

6. (1) This paragraph applies to—

(a) further pensions granted under section 2 of the Act of 1923 to soldiers,

(b) further pensions granted under section 3 of the Act of 1923 to persons ranking as soldiers,

(c) married pensions granted under section 9 of the Act of 1927 to soldiers,

(d) married pensions granted under section 11 of the Act of 1927 to soldiers,

(e) married pensions granted under section 13 of the Act of 1927 to soldiers discharged from the forces before the 1st day of October, 1924,

(f) married pensions granted under section 13 of the Act of 1927 to persons ranking as soldiers, and

(g) married pensions granted to soldiers under sections 10 and 12 of the Act of 1927 as amended by section 3 (6) of the Act of 1943.

(2) A further or married pension to which this paragraph applies shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967, and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (2), (3), (4) and (5) respectively of the Table to this paragraph corresponding to the degree of disablement mentioned in column (1) of that Table.

7 Amendment of Third Schedule to the Act of 1927

7. The Third Schedule to the Act of 1927, as amended by section 13 of the Increase Act of 1964, shall be construed as if—

(a) for the reference in Part I to a married pension of £39 per annum there were substituted with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968 respectively, a reference to a married pension of £41 per annum, £44 10s per annum, £50 per annum and £52 10s per annum, respectively, and

(b) for the reference in Part II to a married pension of nine shillings and ninepence a week, there were substituted, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, a reference to a married pension of ten shillings and three pence a week, eleven shillings and threepence a week, twelve shillings and sixpence a week and thirteen shillings and threepence a week, respectively.

8 Amendment of section 3 of the Act of 1943

8. Section 3 of the Act of 1943, as amended by section 23 of the Increase Act of 1964, shall be construed as if for the reference, in the Table to subsection (5), to a married pension of £58 per annum, there were substituted, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, a reference to a married pension of £61 per annum, £66 10s per annum, £74 10s per annum and £78 per annum, respectively.

9 Increased rates of married pensions under the First Schedule to the Act of 1946, the table to Part III of the First Schedule to the Act of 1949, and Part III of the First Schedule to the No. 2 Act of 1960

9. (1) This paragraph applies to the scales of married pensions in the appropriate colums of—

(a) the First Schedule to the Act of 1946.

(b) the Table to Part III of the First Schedule to the Act of 1949, and

(c) Part III of the First Schedule to the No. 2 Act of 1960

(2) A married pension to which this paragraph applies shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (2), (3), (4), (5), (6), (7), (8) and (9) respectively of the Table to this paragraph corresponding to the degree of disablement mentioned in column (1) of that Table.

10 Increase of allowances payable under the Second and Third Schedules to the Act of 1923 and the Sixth Schedule to the Act of 1927

10. (1) This paragraph applies to allowances payable to the dependants of deceased officers and soldiers of the forces in accordance with—

(a) the Second Schedule to the Act of 1923 (as amended by section 4 of the Increase Act of 1964),

(b) the Third Schedule to the Act of 1923 (as amended by section 5 of the Increase Act of 1964), and

(c) the Sixth Schedule to the Act of 1927 (as amended by section 14 of the Increase Act of 1964).

(2) An allowance to which this paragraph applies and which under the Acts is payable at the rate mentioned in column (2) of the Table to this paragraph at a particular reference number shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (3), (4), (5) and (6) respectively of that Table at that reference number.

11. (1) This paragraph applies to allowances payable to dependants of deceased officers and soldiers of the forces in accordance with—

(a) the Seventh Schedule to the Act of 1927,

(b) Parts III and IV of the Seventh Schedule to the Act of 1927 (inserted by section 5 (5) of the Act of 1943), and

(c) the Second Schedule to the No. 2 Act of 1960.

(2) An allowance to which this paragraph applies and which under the Acts is payable at the rate mentioned in column (2) of the Table to this paragraph at a particular reference number shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, and 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (3), (4), (5) and (6) respectively of the said Table at that reference number.

12. (1) This paragraph applies to gratuities payable under the Acts in accordance with—

(a) sections 1 and 3 of the Act of 1923, as amended by section 2 of the Increase Act of 1964, and section 11 (4) of the Act of 1927, as amended by section 8 of the Increase Act of 1964,

(b) section 12 (4) of the Act of 1927, as amended by section 9 of the Increase Act of 1964, and section 4 (2) (b) (i) of the No. 2 Act of 1960, as amended by section 31 of the Increase Act of 1964,

(c) section 10 (1) of the Act of 1932, as amended by section 16 of the Increase Act of 1964,

13 Increase of wound and disability pensions to members of the Army Nursing Service

13. (1) This paragraph applies to—

(a) disability pensions granted under section 10 of the Act of 1927 to members of the Army Nursing Service in respect of disablement caused by disease attributable to service in the forces during the emergency period.

(b) disability pensions granted under section 10 of the Act of 1927 to members of the Army Nursing Service in respect of disablement caused by disease attributable to service with a United Nations Force, and

(c) wound pensions granted under section 12 of the Act of 1927 to members of the Army Nursing Service in respect of disablement caused by a wound attributable to service in the forces and received on or after the 3rd day of September, 1939.

(2) A wound or disability pension to which this paragraph applies shall with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (2), (3), (4) and (5) respectively of the Table to this paragraph corresponding to the degree of disablement mentioned in column (1) of that Table.

14 Increase of wound, disability and married pensions under section 10 of the Act of 1932

14. (1) (a) A wound pension or a disability pension granted under subsection (1) or subsection (2) of section 10 of the Act of 1932 shall—

(i) with effect from the 1st day of October, 1964, be payable at the increased rate mentioned in column (2) of Table I to this paragraph, and

(ii) with effect from the 1st day of August, 1965, be payable at the increased rate mentioned in column (4) of Table I to this paragraph,

being (in each case) a rate corresponding to the degree of disablement mentioned in column (1) of that Table.

(b) A wound pension or a disability pension granted under subsection (1) or subsection (2) of section 10 of the Act of 1932 shall—

(i) with effect from the 1st day of August, 1967, be payable at the increased rate mentioned in column (2) of Table II to this paragraph, and

(ii) with effect from the 1st day of August, 1968, be payable at the increased rate mentioned in column (4) of Table II to this paragraph,

being (in each case) a rate corresponding to the degree of disablement mentioned in column (1) of that Table.

(2) (a) A married pension granted under section 10 (3) of the Act of 1932 shall—

(i) with effect from the 1st day of October, 1964, be payable at the increased rate mentioned in column (3) of Table I to this paragraph, and

(ii) with effect from the 1st day of August, 1965, be payable at the increased rate mentioned in column (5) of Table I to this paragraph,

being (in each case) a rate corresponding to the degree of disablement mentioned in column (1) of that Table.

(b) A married pension payable under section 10 (3) of the Act of 1932 shall—

(i) with effect from the 1st day of August, 1967, be payable at the increased rate mentioned in column (3) of Table II to this paragraph, and

(ii) with effect from the 1st day of August, 1968, be payable at the increased rate mentioned in column (5) of Table II to this paragraph,

being (in each case) a rate corresponding to the degree of disablement mentioned in column (1) of that Table.

15 Amendment of Second Schedule to the Act of 1932

15. The Second Schedule (which specifies allowances to certain classes of persons) to the Act of 1932 is hereby amended in the following respects—

(a) in paragraph 1 of Part I, " £174 10s ", " £190 ", " £213 " and " £223 10s " shall, with effect from the 1st day ofOctober, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £166 " (inserted by section 17 of the Increase Act of 1964),

(b) in paragraphs 2 and 3 of Part I, " £46 10s " and " £78 " " £50 10s " and " £85 ", " £56 10s " and " £95 ", " £59 10s." and " £100 " shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £44 10s " and " £74 10s." (inserted by section 17 of the Increase Act of 1964) respectively, and

(c) in paragraph 5 of Part II, " £1 19s ", " £2 2s 6d ", " £2 7s 6d ", and " £2 10s " shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £1 17s 3d " (inserted by section 17 of the Increase Act of 1964).

16 Increase of allowances to certain relatives of Signatories to the Proclamation published on Easter Monday 1916

16. (1) Section 3 (1) of the Act of 1937 is hereby amended by the substitution, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, in paragraph (a) (which relates to the allowance payable to the widow (if any) of a Signatory to the Proclamation published on Easter Monday, 1916) of " seven hundred and ninety-nine pounds ", " eight hundred and seventy-one pounds ", " nine hundred and seventy-five pounds and ten shillings " and " one thousand and twenty-four pounds and ten shillings ", respectively, for " seven hundred and sixty-one pounds " (inserted by section 18 of the Increase Act of 1964).

(2) Section 3 (1) of the Act of 1937 is hereby further amended by the substitution, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, in paragraph (c) (which relates to the allowance payable to each sister of such Signatory) of " three hundred and forty-seven pounds and ten shillings ", " three hundred and seventy-nine pounds ", " four hundred and twenty-four pounds and ten shillings " and " four hundred and forty-five pounds and ten shillings ", respectively, for " three hundred and thirty-one pounds " (inserted by section 18 of the Increase Act of 1964).

17 Increase of final pensions under section 26 of the Act of 1937, section 6 of the Act of 1941, section 6 of the Act of 1943 and Section 5 of the No. 2 Act of 1960

17. (1) Every final pension under section 26 of the Act of 1937, section 6 of the Act of 1941, section 6 of the Act of 1943 and section 5 of the No. 2 Act of 1960, which is payable at the rate of one pound seventeen shillings and three pence per week shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the rate of one pound and nineteen shillings per week, two pounds two shillings and six pence per week, two pounds seven shillings and six pence per week, and two pounds and ten shillings per week, respectively.

(2) Every final pension under section 26 of the Act of 1937, section 6 of the Act of 1941, section 6 of the Act of 1943 and section 5 of the No. 2 Act of 1960, which is payable at the rate of two pounds nine shillings and three pence per week shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the rate of two pounds eleven shillings and nine pence per week, two pounds sixteen shillings and six pence per week, three pounds three shillings and three pence per week and three pounds six shillings and six pence per week, respectively.

18 Increase of aggravation pensions under sections 28 and 29 of the Act of 1937, section 12 of the Act of 1946 and section 7 of the No. 2 Act of 1960

18. (1) This paragraph applies to pensions granted under—

(a) section 28 and section 29 of the Act of 1937 (which provide for pensions to former members of the forces and members of certain organisations in respect of wounds or disease aggravated by service),

(b) section 12 of the Act of 1946 (which provides for pensions in respect of tuberculosis aggravated by service during the emergency period), and

(c) section 7 of the No. 2 Act of 1960 (which provides for pensions in respect of disease aggravated by service with a United Nations Force).

(2) A pension to which this paragraph applies shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be payable at the increased rate mentioned in columns (2), (3), (4) and (5) respectively of the Table to this paragraph corresponding to the degree of disablement mentioned in column (1) of that Table.

20. The Second Schedule (which specifies allowances to dependants of certain deceased persons) to the Act of 1962 is hereby amended by the substitution—

21 Amendment of section 7 of the Act of 1943

21. For the purposes of section 7 of the Act of 1943, as amended by subsections (1), (2) and (3) of section 41 of the Act of 1953—

(a) the expression " the appropriate annual sum " means, in respect of a person whose age is seventy years or more—

(i) in relation to a single man or woman or to a widower or widow with no children, £112 with effect from the 1st day of October, 1964, £120 with effect from the 1st day of August, 1965, £130 with effect from the 1st day of August, 1967 and £135 with effect from the 1st day of August, 1968,

(ii) in relation to a widower or widow who has children, the sum of the following amounts, namely, £112 and £11 14s in respect of each child with effect from the 1st day of October, 1964, £120 and £11 14s in respect of each child with effect from the 1st day of August, 1965, £130 and £12 in respect of each child with effect from the 1st day of August, 1967 and £135 and £12 in respect of each child with effect from the 1st day of August, 1968,

(iii) in relation to a married man or woman whose spouse is living and who has no children and who is in receipt of an old age (contributory) pension under the Social Welfare Acts, 1952 to 1968, or whose spouse is in receipt of such pension or of an old age (non-contributory) pension or a blind pension under the Old Age Pensions Acts, 1908 to 1968, £131 10s with effect from the 1st day of October, 1964, £139 10s with effect from the 1st day of August, 1965, £150 with effect from the 1st day of August, 1967 and £155 with effect from the 1st day of August, 1968,

(v) in relation to a married man or woman whose spouse is living and who has children and who is in receipt of an old age (contributory) pension under the Social Welfare Acts, 1952 to 1968, or whose spouse is in receipt of such pension or of an old age (non-contributory) pension or a blind pension under the Old Age Pensions Acts, 1908 to 1968, the sum of the following amounts, namely, £131 10s and £11 14s in respect of each child with effect from the 1st day of October, 1964, £139 10s and £11 14s in respect of each child with effect from the 1st day of August, 1965, £150 and £12 in respect of each child with effect from the 1st day of August, 1967 and £155 and £12 in respect of each child with effect from the 1st day of August, 1968, and

(vi) in relation to any married man or woman not mentioned in subparagraph (v) above whose spouse is living and who has children, the sum of the following amounts, namely, £155 and £11 14s in respect of each child with effect from the 1st day of October, 1964, £163 and £11 14s in respect of each child with effect from the 1st day of August, 1965, £173 and £12 in respect of each child with effect from the 1st day of August, 1967 and £178 and £12 in respect of each child with effect from the 1st day of August, 1968,

(b) the expression " the appropriate annual sum " means, in respect of a person whose age is less than seventy years—

(i) in relation to a single man or woman or to a widower or widow with no children, £138 with effect from the 1st day of October, 1964, £146 with effect from the 1st day of August, 1965, £156 with effect from the 1st day of August, 1967 and £161 with effect from the 1st day of August, 1968,

(ii) in relation to a widower or widow who has children, the sum of the following amounts, namely, £138 and £11 14s in respect of each child with effect from the 1st day of October, 1964, £146 and £11 14s in respect of each child with effect from the 1st day of August, 1965, £156 and £12 in respect of each child with effect from the 1st day of August, 1967 and £161 and £12 in respect of each child with effect from the 1st day of August, 1968,

(iii) in relation to a married man or woman whose spouse is living but who has no children, £164 with effect from the 1st day of October, 1964, £172 with effect from the 1st day of August, 1965, £182 with effect from the 1st day of August, 1967 and £187 with effect from the 1st day of August, 1968,

(iv) in relation to a married man or woman whose spouse is living and who has children, the sum of the following amounts, namely, £164 and £11 14s in respect of each child with effect from the 1st day of October, 1964, £172 and £11 14s in respect of each child with effect from the 1st day of August, 1965, £182 and £12 in respect of each child with effect from the 1st day of August, 1967 and £187 and £12 in respect of each child with effect from the 1st day of August, 1968.

22 Increase of allowances under section 4 of the Act of 1953

22. Section 4 (1) of the Act of 1953 (which provides for allowances to certain relatives of certain deceased persons with pre-truce military service) is hereby amended in the following respects—

(1) in paragraph (a), " £347 10s ", " £379 ", " £424 10s " and " £445 10s " respectively, shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £331 " (inserted by section 29 of the Increase Act of 1964),

(2) in paragraphs (aa) and (ab) (inserted by section 8 of the Act of 1959), " £174 10s ", " £190 ", " £213 " and £223 10s ", respectively, shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £166 " (inserted by section 29 of the Increase Act of 1964),

(3) in paragraph (b) " £250 10s ", " £273 ", " £306 " and £321 10s. ", respectively, shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £238 10s " (inserted by section 29 of the Increase Act of 1964), and

(4) in paragraphs (c) and (d), " £174 10s ", " £190 ", " £213 " and " £223 10s ", respectively, shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £166 " (inserted by section 29 of the Increase Act of 1964).

23 Increase of allowances to certain children of Signatories to the Proclamation published on Easter Monday, 1916

23. In section 45 (1) of the Act of 1953 (which relates to the allowances payable to certain children of Signatories to the Proclamation published on Easter Monday, 1916) " £174 10s ", £190 ", " £213 " and " £223 10s ", respectively, shall, with effect from the 1st day of October, 1964, the 1st day of August, 1965, the 1st day of August, 1967 and the 1st day of August, 1968, respectively, be substituted for " £166 " (inserted by section 30 of the Increase Act of 1964).

EXPLANATORY NOTE.

These Regulations provide for the Budgetary increases effective from 1st October, 1964, 1st August, 1965, 1st August, 1967 and 1st August, 1968 in pensions, allowances (including special allowances) and gratuities payable under the Army Pensions Acts, 1923 to 1968.
