PROTECTION OF ANIMALS (APPROVED SPRING TRAPS) ORDER, 1968.

I, Neil T. Blaney, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 8 of the Protection of Animals (Amendment) Act, 1965 (No. 10 of 1965), hereby order as follows:—

1. (1) This Order may be cited as the Protection of Animals (Approved Spring Traps) Order, 1968.

(2) This Order shall come into operation on the 1st day of June, 1968.

2. For the purposes of section 8 of the Protection of Animals (Amendment) Act, 1965 (No. 10 of 1965)—

(a) a spring-operated cage or net trap is hereby declared to be an approved spring trap for the taking of animals, and

(b) a spring trap which is not a gin trap and which is designed to secure either—

(i) the immediate death, or

(ii) the immediate unconsciousness and subsequent death without intervening consciousness, of an animal which it is designed to trap is hereby declared to be an approved spring trap for the killing of animals.

EXPLANATORY NOTE.

Section 8 of the Protection of Animals Act, 1965, provides that after 1st June, 1968, it shall be an offence to sell or to use for the purpose of taking or killing animals a spring trap other than a trap of a type approved by Order of the Minister for Agriculture and Fisheries. This Order approves, for the purposes of the Act, traps of the types specified in Article 2.
