COMMITTEES OF AGRICULTURE (SALARIES OF OFFICERS) REGULATIONS, 1968.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 27 (1) of the Agriculture Act, 1931 (No. 8 of 1931), and section 6 of the Agriculture (Amendment) Act, 1958 (No. 17 of 1958), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1965 ( S.I. No. 146 of 1965 ), hereby make the following regulations:—

1. (1) These Regulations may be cited as the Committees of Agriculture (Salaries of Officers) Regulations, 1968.

(2) The Committees of Agriculture (Salaries of Officers) Regulations, 1966 ( S.I. No. 187 of 1966 ), and these Regulations may be cited together as the Committees of Agriculture (Salaries of Officers) Regulations, 1966 and 1968.

2. These regulations shall be deemed to have come into operation on the 1st day of June, 1966, except that—

(a) for the purposes of paragraph 7 (1) of and Tables III, IV, V and VI contained in Part III of the Schedule hereto they shall be deemed to have come into operation on the 1st day of April, 1966, and

(b) for the purposes of paragraph 8 (1) of and Table VII contained in Part III of the said Schedule they shall be deemed to have come into operation on the 1st day of April, 1965.

3. The scales of salaries for such officers of committees of agriculture holding office in a pensionable capacity as are specified in the Schedule hereto shall be in accordance with the provisions of that Schedule.

4. The Committees of Agriculture (Salaries of Officers) Regulations, 1964 ( S.I. No. 239 of 1964 ), and the Committees of Agriculture (Salaries of Officers) Regulations, 1965 ( S.I. No. 67 of 1965 ), are hereby revoked.

SCHEDULE.

PART I.

PRELIMINARY AND GENERAL.

1. (1) In this Schedule—

"the Minister" means the Minister for Agriculture and Fisheries;

"committee" means a committee of agriculture;

"existing" in relation to an officer of a Committee means a person who was an officer of a committee on the 1st day of June, 1966, or who became an officer of a committee after that day and before the day of the making of these egulations, except that—

(a) with respect to clerical officers it means for the purposes of paragraph 7 of this Schedule and of Tables III, IV, V and VI, contained in Part III hereof a person who was an officer of a committee on the 1st day of April, 1966, or who became an officer of a committee after that day and before the making of these Regulations, and

(b) with respect to clerk typists it means for the purpose of paragraph 8 of this Schedule and of Table VII contained in Part III hereof a person who was an officer of a committee on the 1st day of April, 1965, or who became an officer of a committee after that day and before the making of these Regulations;

"salary" shall be construed as meaning, in relation to any officer of a committee, annual salary exclusive of —

(a) any allowance for cost of subsistance, hotel expenses and travelling, and

(b) any additional temporary remuneration in respect of the performance in a temporary capacity of the duties of an office higher than the officer's ordinary office.

(2) Where a person, who was an officer of a committee (in this subparagraph referred to as the abolished committee) appointed under the Agriculture and Technical Instruction (Ireland) Act, 1899, by the Council of a county or of such council in relation to or for the purpose of functions, powers and duties performed by such council through such committee, was transferred to a committee of agriculture by section 43 of the Agriculture Act, 1931 (No. 8 of 1931), the service of that person under the abolished committee shall for the purposes of this Schedule be treated as service with that committee of agriculture.

(3) Service of an officer with a committee shall for the purposes of this Schedule include service of the officer with the committee before the making of these Regulations.

2. The following provisions shall have effect in relation to increments of salaries of officers of committees under this Schedule:

(a) no increment shall be granted by a committee to any officer without the written approval of the Minister;

(b) any increment or increments authorised by this Schedule to be granted to an officer of a committee may be withheld if the service of the officer is not in the opinion of the committee or the Minister satisfactory;

(c) any increment or increments granted to an officer of a committee may be withdrawn if the service of the officer is not in the opinion of the committee or the Minister satisfactory.

3. (1) Where—

(a) an appointment to any office to which this paragraph applies is made by a committee (in this paragraph referred to as the appointing committee), and

(b) the person appointed to that office (in this paragraph referred to as the said office) held previous to that appointment one or more of the following, that is to say :—

(i) an office similar to the said office under a committee, or

(ii) an office under the Minister, or

(iii) an appointment specially approved by the Minister for the purposes of this paragraph,

the appointing committee may, subject to the provisions of this paragraph, fix the initial salary of that person at an incremental point higher than the minimum salary under this Schedule for the said office and, for this purpose, the appointing committee may take into account and have regard to the period or periods during which that person held one or more of the following, that is to say, the offices mentioned at (i) and (ii) or the appointment mentioned at (iii) of this subparagraph.

(2) Where the person appointed to the said office held, immediately prior to that appointment, an office (in this subparagraph referred to as the previous office) under a committee, the initial salary to be fixed in accordance with the provisions of this paragraph by the appointing committee shall not be lower than the salary of that person in respect of the previous office immediately prior to his appointment to the said office.

(3) A committee shall not exercise the power conferred by this paragraph unless—

(a) the committee has obtained the prior sanction of the Minister for the exercise of the power, and

(b) notice of intention to exercise the power has been given in such manner as the Minister may direct to all prospective candidates for the office in respect of which the power is proposed to be exercised, and

(c) the sanction of the Minister for the actual initial salary proposed has been obtained.

(4) This paragraph applies to each of the following offices under a committee:

(a) the office of Instructor in Agriculture,

(b) the office of Instructor in Horticulture and Bee-keeping,

(c) the office of Instructor in Poultry-keeping and Butter-making.

(5) Any appointment which, immediately before the 1st day of June, 1966, stood especially approved by the Minister for the purposes of paragraph 3 of the Schedule to the Committees of Agriculture (Salaries of Officers) Regulations, 1965, or stood regarded as so specially approved shall be regarded as an appointment specially approved by the Minister for the purposes of this paragraph.

PART II.

SCALES OF SALARIES.

4. (1) Existing officers shall, subject to the next subparagraph, enter on the scales of salary prescribed by this Part in accordance with the Tables contained in Part III.

(2) The said Tables shall have effect subject to the following provisions:

(a) references to the relevant date shall be construed as references to either—

(i) the 1st day of June, 1966, in the case of Tables I and II or the later day on which the person concerned became an officer of a committee,

(ii) the 1st day of April, 1966, in the case of Tables III, IV and VI or the later day on which the person concerned became an officer of a committee,

(iii) the 1st day of July, 1967, in the case of Table V or the later day on which the person concerned became an officer of a committee,

(iv) the 1st day of April, 1965, in the case of Table VII or the later day on which the person concerned became an officer of a committee,

as may be appropriate;

(b) where an officer's pay as referred to in any Table would have been between two successive points which differ in amount, the entry point on the new scale shall be calculated on a proportionate basis.

(3) An officer of a committee shall not proceed or be allowed to proceed on the scale of salary prescribed by this Part of this Schedule in relation to that officer further than the point reached at the incremental date immediately preceding the date on which that officer attained the age of sixty-five years.

5. (1) Subject to the provisions of paragraph 4 of this Schedule, the scale of salary for Instructors in Agriculture and Instructors in Horticulture and Bee-keeping, being male or existing female Instructors, shall be £840—£65—£1,035—£195—£1,230—£65—£1,880 per annum.

(2) A long service increment of £70 shall be allowed after an Instructor has been 3 years on the maximum of the scale. In the case of an Instructor who has not been 3 years on the maximum of the scale, but to whom on this appointment to his current post of Instructor, the appointing committee opted to give credit for previous service, any of this service in excess of 14 years shall be regarded as service for the purpose of the award of the long service increment.

(3) There shall be paid in addition to the amount payable under subparagraph (1)—

(a) in case, but only in case, the amount payable per annum to the Instructor by virtue of subparagraph (1), after the deduction of superannuation contribution, where applicable, does not exceed £1,200—£52 per annum,

(b) in case, but only in case, the amount payable per annum to the Instructor by virtue of subparagraph (1), after the deduction of superannuation contribution, where applicable, exceeds £1,200—an amount per annum equal to the amount by which £1,252 exceeds the amount payable as aforesaid.

6. (1) Subject to the provisions of paragraph 4 of this Schedule, the scale of salary for Instructors in Poultry-keeping and Butter-making shall be £675—£54—£1,161—£49—£1,210 per annum.

(2) A long service increment of £50 shall be allowed after an Instructor has been 3 years on the maximum of the scale. In the case of an Instructor who has not been 3 years on the maximum of the scale, but to whom on her appointment to her current post of Instructor the appointing committee opted to give credit for previous service, any of this service in excess of 10 years may be regarded as service for the purpose of the award of the long service increment.

(3) There shall be paid to an Instructor in addition to the amount payable per annum under subparagraph (1), or subparagraph (1) and subparagraph (2), whichever is appropriate—

(a) in case, but only in case, the amount so payable to the Instructor, after the deduction of superannuation contribution, where applicable, does not exceed £1,200—£39 per annum.

(b) in case, but only in case, the amount so payable to the Instructor, after the deduction of superannuation contribution, where applicable, exceeds £1,200—an amount per annum equal to the amount by which £1,239 exceeds the amount payable as aforesaid.

7. (1) Subject to the provisions of paragraph 4 of this Schedule, the scales of salaries for clerical officers shall be as follows :—

(a) in the case of male officers appointed before the 23rd day of January, 1961: £470—£30—£620—£56—£676—£45—£1,126—£50—£1,176 per annum,

(b) in the case of male officers appointed on or after the 23rd day of January, 1961, and before the 1st day of July, 1967: £400—£40—£600—£76—£676—£45—£ 1,126—£50—£1,176 per annum,

(c) in all other cases: £400—£40—£600—£76—£676—£40—£916—£45—£1,051 per annum.

(2) With effect from the 1st day of June, 1966, there shall be paid to a clerical officer in addition to the amount payable per annum under clause (a), (b) or (c) of subparagraph (1), whichever is appropriate—

(a) in case, but only in case the officer is more than 21 years of age—£52 per annum,

(b) in case, but only in case, the officer is 18 years of age and not more than 21 years of age £39 per annum,

(c) in case, but only in case the officer is less than 18 years of age £32. 10. 0 per annum.

(3) In case a male clerical officer appointed before the 1st day of July, 1967, is married prior to the 1st day of April, 1966, or gets married on or subsequent to the last mentioned day he shall—

(a) in case he is married on a date prior to the 1st day of April, 1965—with effect from the 1st day of April, 1966, be allowed two additional increments;

(b) in case he is married on or subsequent to the 1st day of April, 1965—on the incremental date immediately following his marriage or on the 1st day of April, 1966, whichever is the later, be allowed an additional increment and on the incremental date next following he shall be allowed a further additional increment,

provided that in no case shall an officer be paid more than the maximum on the scale.

(4) In case a male clerical officer appointed on or after the 1st day of July, 1967, is married at the date of his appointment or gets married subsequent to that date he shall, as from the date of his appointment or marriage, whichever is the later, be entitled to a marriage allowance of £125 per annum.

(5) A male clerical officer appointed before the 1st day of July, 1967, and who is married shall have the option to at any time enter on the scale of salary specified in subparagraph (1) (c) and, in case an officer exercises an option under this subparagraph, subparagraph (4) shall apply in relation to him and he shall enter on such scale at the incremental point corresponding to the point on the scales specified in clause (a) or clause (b) of subparagraph (1), as may be appropriate, which he would have reached if at the date of exercising the option he had been unmarried.

8. (1) Subject to the provisions of paragraph 4 of this Schedule, the scale of salaries for clerk typists shall be £400—£34—£740—£30—£770 per annum.

(2) With effect from the 1st day of June, 1966, there shall be paid to clerk typists in addition to the amount payable per annum under subparagraph (1)—

(a) in the case of clerk typists who are 18 years of age, or over—£39 per annum,

(b) in all other cases—£32. 10. 0 per annum.

PART III.

TABLES (ENTRY POINTS FOR EXISTING OFFICERS).

TABLE I—INSTRUCTORS IN AGRICULTURE AND INSTRUCTORS IN HORTICULTURE AND BEE-KEEPING.

(1) In case the salary per annum on the former scale which would have been appropriate on the relevant date, after the deduction of superannuation contribution, where applicable, would not have exceeded £1,200, the salary payable on the new scale shall be an amount equal to the salary which would have been so appropriate increased by £52 per annum.

(2) In case the salary per annum on the former scale which would have been so appropriate, after such deduction where applicable, would have exceeded £1,200 but would not have exceeded the aggregate of such £1,200 and £52 per annum, the salary payable on the new scale shall be—

( a ) in case such deduction is applicable—£1,315 per annum,

( b ) in case such deduction is not applicable—£1,252 per annum.

(3) In case the salary per annum on the former scale which would have been so appropriate, after such deduction where applicable, would have exceeded—

( a ) in case such deduction is applicable—£1,315 per annum,

( b ) in case such deduction is not applicable—£1,252 per annum,

the salary payable on the new scale shall be an amount per annum equal to the salary first mentioned.

TABLE II—INSTRUCTORS IN POULTRY-KEEPING AND BUTTER-MAKING.

1. In case the salary per annum on the former scale which would have been appropriate on the relevant date, after the deduction of superannuation contribution where applicable, would not have exceeded £1,200, the salary payable on the new scale shall be an amount equal to the salary which would have been so appropriate increased by £39 per annum.

(2) In case there is no superannuation contribution and the salary per annum on the former scale which would have been so appropriate would have exceeded £1,200 but would not have exceeded £1,239, the salary payable on the new scale shall be £1,239 per annum.

(3) In case there is no superannuation contribution and the salary per annum on the former scale which would have been so appropriate would have exceeded £1,239, the salary payable on the new scale shall be an amount per annum equal to the salary first mentioned.

EXPLANATORY NOTE.

These Regulations prescribe scales of salaries for Instructors in Agriculture, Instructors in Horticulture and Beekeeping, Instructors in Poultry-Keeping and Buttermaking, clerical officers and clerk typists holding office in a pensionable capacity under Committees of Agriculture.
