SECONDARY TEACHERS' SUPERANNUATION (AMENDMENT) SCHEME, 1968.

I, DONOGH O'MALLEY, Minister for Education, in exercise of the powers conferred on me by the Teachers' Superannuation Act, 1928 , (No. 32 of 1928), and with the consent of the Minister for Finance, hereby make the following Scheme:

1. This Scheme may be cited as the Secondary Teachers' Superannuation (Amendment) Scheme, 1968, and the Secondary Teachers' Superannuation Schemes, 1929, to 1967, and this Scheme may be cited together as the Secondary Teachers' Superannuation Scheme, 1929 to 1968.

2. This Scheme shall come into force immediately upon its being confirmed by each House of the Oireachtas.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. Paragraph 17 of the Secondary Teachers' Superannuation Scheme, 1929, (S.R. and O., No. 19 of 1929), is hereby amended by the addition to subparagraph (2) of the following proviso :

"Provided that a teacher who reached the age of sixty-five years on the 31st day of July, 1966, or during the three months ended or ending on any subsequent 31st day of July shall, notwithstanding the foregoing provision, retire not later than the day, subsequent, but not more than three months subsequent, to the day on which he reaches the age of sixty-five years, on which he completes a year of contributing service."

EXPLANATORY NOTE.

This amending Scheme provides that, on or after 31 July, 1966, a member of the Scheme whose date of birth occurs within the final quarter of a school year (from 1st May to 31st July), may continue in approved teaching service and in membership of the Scheme, for a period of not more than three months from the date on which he reaches the age of 65 years, provided that by doing so he completes an additional year of pensionable service.
