FOOT AND MOUTH DISEASE (RESTRICTION OF SPORTS AND SALES) ORDER, 1967.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 and 48 of the Diseases of Animals Act, 1966 (No. 6 of 1966), for the prevention of the spreading of foot and mouth disease, hereby order as follows:

1. This Order may be cited as the Foot and Mouth Disease (Restriction of Sports and Sales) Order, 1967.

2. In this Order—

"game" has the same meaning as in section 2 of the Game Preservation Act, 1930 (No. 11 of 1930);

"hunting" means the use of hounds, beagles or other dogs for the purpose of hunting or coursing any deer, fox, otter, hare, rabbit or other prey, or for hunting any drag trail.

3. This Order shall come into force on the 24th day of November, 1967, and shall continue in force up to and including the 22nd day of December, 1967.

4. The following sports and sales are hereby prohibited:

(a) horse-racing, horse jumping competitions, hunting and dog-racing;

(b) the training of any dog for any kind of dog-racing or for coursing;

(c) the pursuit whether by shooting or otherwise of—

(i) game or rabbits,

(ii) badgers, foxes, otters or other vermin, on any land by any person other than the person who is in occupation of the land;

(d) fishing by rod and line (other than sea-fishing) otherwise than from land, or from waters covering land, of which the person fishing is in occupation;

(e) rallies, scrambles or other motor car or motor cycle sporting events which are not held wholly on a road which is a public road within the meaning of section 3 of the Road Traffic Act, 1961 (No. 24 of 1961);

(f) the public sale of dogs of any kind.

5. (1) An inspector may, if authorised by the Minister so to do. by notice in writing served upon the promoters or organisers of any sporting fixture (other than a sporting fixture prohibited by Article 4) specified in the notice, require the promoters or organisers not to hold the fixture to which the notice relates.

(2) The failure by any person, whether by act or omision, to comply with the requirements of a notice served on him under this Article, is hereby declared to be an offence.

EXPLANATORY NOTE.

This Order

I prohibits from 24th November, 1967 to 22nd December, inclusive

(a) horse-racing, horse jumping competitions, hunting, dog-racing, coursing and the training of any dog for dog-racing or coursing,

(b) the hunting of game, rabbits, badgers, foxes, otters or other vermin, on any land by any person other than the person who is in occupation of the land,

(c) fishing by rod and line (other than sea fishing) otherwise than from land, or from waters covering land, of which the person fishing is in occupation,

(d) motor car or motor cycle events otherwise than on a public road,

(e) the public sale of dogs.

II empowers an authorised inspector of the Minister for Agriculture and Fisheries to prohibit by notice served on the promoters or organisers the holding of any sporting fixture not otherwise prohibited by this Order.
