DISEASES OF ANIMALS ACT, 1966 (SECTION 54) (APPOINTED DAY AND EXEMPTIONS) ORDER, 1967.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 54 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:—

1. This Order may be cited as the Diseases of Animals Act, 1966 (Section 54) (Appointed Day and Exemptions) Order, 1967.

2. In this Order—"animal" means a bovine animal; "herd" includes a herd consisting of one animal only; "the Minister" means the Minister for Agriculture and Fisheries; "the subsection" means subsection (1) of section 54 of the Diseases of Animals Act, 1966 (No. 6 of 1966).

3. For the purposes of the subsection, the 1st day of February, 1969, is hereby appointed as the day on or after which, no person shall sell, offer or expose for sale or export or expose for export any horned cattle.

4. The following are hereby exempted from the application of the subsection, namely:

(a) any animal born on or before the 1st day of March, 1965;

(b) any bull which is either entered or accepted for entry in a herd book recognised by the Minister for the purposes of this Order and in respect of which a licence has been granted by the Minister under section 2 of the Live Stock Breeding Act, 1925 (No. 3 of 1925), and which is for the time being in force;

(c) any pedigree Kerry, Hereford or Charolais female animal which is entered in the Herd Book of its breed; provided that animal is—

(i) sold at a public sale which is for the sale of pedigree breeding stock only and is approved by the Minister for the purposes of this Order,

(ii) sold at a sale for the dispersal of a herd of pedigree cattle which is approved by the Minister for the purposes of this Order,

(iii) privately sold ex farm for breeding purposes,

(iv) from a pedigree herd and is sold for immediate slaughter by the purchaser under and in accordance with a licence granted by the Minister in that behalf,

(v) exported for breeding purposes under and in accordance with a licence granted by the Minister in that behalf.

5. The Minister may grant licences for the purposes of this Order.

EXPLANATORY NOTE.

The Order provides that on and after 1st February, 1969, it shall be an offence to sell or expose for sale, or to export or expose for export any horned cattle. There are certain very limited exemptions in relation to pedigree licensed bulls and pedigree females of the Kerry, Hereford and Charolais breeds.
