ROAD TRAFFIC (LIGHTING OF VEHICLES) (AMENDMENT) REGULATIONS, 1967.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 11 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic (Lighting of Vehicles) (Amendment) Regulations, 1967.

(2) In these Regulations :—

" the Principal Regulations " means the Road Traffic (Lighting of Vehicles) Regulations, 1963 ( S.I. No. 189 of 1963 );

" obstruction lamp " means a lamp which shows a flashing yellow light visible through 360 degrees in azimuth having a power which does not exceed 50 watts and which is carried at a height of not less than five feet above the ground.

(3) The Principal Regulations and these Regulations shall be construed as one and may be cited together as the Road Traffic (Lighting of Vehicles) Regulations, 1963 and 1967.

2. The requirements of Part VI of the Principal Regulations shall not apply to an obstruction lamp or a searchlight which is carried on an ambulance, rescue vehicle or firefighting vehicle, the property of the Minister for Transport and Power and which is normally at or in the vicinity of an airport which is the property of the State.

3. Where an ambulance, rescue vehicle or firefighting vehicle referred to in article 2 of these Regulations is equipped with an obstruction lamp or a searchlight such obstruction lamp or searchlight shall not be used while the vehicle is on a public road except during an emergency or training exercise.

4. The requirements of Part VI of the Principal Regulations shall not apply to an obstruction lamp which is carried on a radio vehicle or other service vehicle, the property of the Minister for Transport and Power and which is used normally at or in the vicinity of an airport which is the property of the State.

5. Where a radio vehicle or other service vehicle referred to in article 4 of these Regulations is equipped with an obstruction lamp, such lamp shall not be used while the vehicle is on a public road.

6. The Principal Regulations are hereby amended in the manner set out in the Schedule to these Regulations.

SCHEDULE.

1. In paragraph (a) of sub-article (1) of article 20 " all " shall be substituted for " any ".

2. In sub-article (1) of article 28 " all " shall be substituted for " any ".

3. In paragraph (a) of sub-article (2) of article 49 "Lamps to which article 47 of these Regulations applies shall be dipped in good time whenever, while the vehicle is being used in a public place and the said lamps are lit " shall be substituted for " Head lamps shall be dipped in good time whenever, while the vehicle is being used in a public place and the head lamps are lit ".

4. In paragraph (b) of sub-article (2) of article 49 "Lamps to which article 47 of these Regulations applies shall be dipped whenever, while the vehicle is being used in a public place and the said lamps are lit " shall be substituted for " Head lamps shall be dipped whenever, while the vehicle is being used in a public place and the head lamps are lit ".

5. In sub-paragraph (i) of paragraph (b) of sub-article (2) of article 49, after the word " applies " there shall be inserted the words " except where public streeet lighting is either not provided or, having been provided, is not in operation ".

6. In sub-article (3) of article 49 after " change of direction " at the end of the sub-article there shall be added the words " except in the case of a vehicle on which all direction indicators are of the flashing type and amber in colour and they are all lit simultaneously on a stationary vehicle to indicate that it has broken down or to warn against danger ".

7. In paragraph (a) of sub-article (18) of article 52 after " ambulance ", there shall be inserted the words " a vehicle used for the delivery or collection of human blood or human blood products,".

EXPLANATORY NOTE.

The effect of these regulations is to amend the Road Traffic (Lighting of Vehicles) Regulations, 1963 so as to permit the fitting and the use of obstruction lamps and searchlights on particular airport vehicles in certain circumstances and to permit the simultaneous use of all amber flashing indicators on a stationary vehicle as a danger warning. The amendments also permit the use of undipped head-lamps in built-up areas where street lighting is not provided or is not in operation. Other minor amendments of the 1963 Regulations are also made.
