FACTORIES (FEES OF CERTIFYING DOCTORS) REGULATIONS, 1965.

I, PÁDRAIG Ó h-IRIGHILE, Minister for Industry and Commerce, in exercise of the power conferred on me by section 97 of the Factories Act, 1955 (No. 10 of 1955), hereby make the following regulations :

1.—(1) These Regulations may be cited as the Factories (Fees of Certifying Doctors) Regulations, 1965.

(2) These Regulations shall come into operation on the 1st day of October, 1965.

2. In these Regulations " the Act " means the Factories Act, 1955 (No. 10 of 1955).

3.—(1) The fees to be paid to certifying doctors for carrying out—

(a) their duties in relation to examination of young persons under section 80 of the Act, including the issue or refusal of a certificate of fitness under subsection (1) or subsection (2) and the issue of a provisional certificate under subsection (3) of that section, and

(b) their duties in relation to examination of women or young persons in accordance with regulations for the purposes of section 70 of the Act and examination of persons employed in accordance with special regulations for the purposes of section 71 of the Act, including any entries in registers, issue of certificates and the carrying out of other duties as may be required by the regulations in connection with the examination,

shall be :

(i) where the examination is at the place of employment five shillings for each person examined (with a minimum fee of twelve shillings and sixpence for any one visit) together with, if the place of employment is one and one-half miles or more from the central point, one shilling and three-pence for each complete half-mile over one mile, and

(ii) where the examination is not at the place of employment but at a place appointed by the certifying doctor for the purpose, five shillings for each person examined.

(2) In this Regulation " the central point " means a place fixed by the Minister for Industry and Commerce with respect to the certifying doctor as the place for the calculation of mileage for the purpose of this Regulation or, where no place is so fixed, the residence of the certifying doctor.

4. The fees to be paid to certifying doctors for carrying out their duties relating to investigations and reports under section 79 of the Act shall be :

(i) where the distance which the certifying doctor has to travel does not exceed one mile, ten shillings.

(ii) where that distance exceeds one mile but does not exceed two miles, twelve shillings and sixpence,

(iii) where that distance exceeds two miles but is less than three and one-half miles, fifteen shillings,

(iv) where that distance is three and one-half miles or more, fifteen shillings for the first three miles together with one shilling and three pence for each complete half-mile over three miles.

5. The Factories (Fees of Certifying Doctors) Regulations, 1956 ( S.I. No. 253 of 1956 ), are hereby revoked.

EXPLANATORY NOTE

This Instrument prescribes the fees to be paid to Certifying Doctors for their duties under the Factories Act, 1955 .
