TRANSPORT, FUEL AND POWER (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1965.

The Government, in exercise of the powers conferred on them by subsection (1) of section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows:

1. This Order may be cited as the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1965.

2. In this Order—

"functions" includes powers and duties;

"operative date" means the date of this Order.

3. The administration and business in connection with the exercise, performance or execution of the functions transferred by Article 4 of this Order are hereby transferred to the Department of Transport and Power.

4.—(1) The functions vested in the Minister for Industry and Commerce under subsections (2) and (6) of section 31 of the Health Act, 1947 (No. 28 of 1947), are hereby transferred to the Minister for Transport and Power.

(2) References to the Minister for Industry and Commerce contained in any Act or instrument made thereunder and relating to the functions transferred by paragraph (1) of this Article shall, on and after the operative date, be construed as references to the Minister for Transport and Power.

EXPLANATORY NOTE.

This Order transfers to the Minister for Transport and Power and to the Department of Transport and Power, respectively, with effect as from the date of this Order, certain Ministerial functions and Departmental Administration in relation to (i) the enforcement and execution in any Customs-free Airport of regulations made by the Minister for Health, under the Health Act, 1947 , for preventing the spread of infectious disease and (ii) the making of such regulations relating to passenger vehicles.
