RETURNING OFFICERS' (BOROUGH AND COUNTY CONSTITUENCIES) CHARGES ORDER, 1965.

I, SÉAMUS Ó RIAIN, Minister for Finance, in exercise of the powers conferred on me by subsection (5) of section 25 of the Electoral Act, 1923 (No. 12 of 1923), hereby order as follows:

1. (1) This Order may be cited as the Returning Officers' (Borough and County Constituencies) Charges Order, 1965.

(2) The Returning Officers' (Borough and County Constituencies) Charges Orders, 1937 to 1964, and this Order may be cited as the Returning Officers' (Borough and County Constituencies) Charges Orders, 1937 to 1965.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

"the Order of 1948" means the Returning Officers' (Borough and County Constituencies) Charges Order, 1948 ( S.I. No. 23 of 1948 );

"the Order of 1961" means the Returning Officers' (Borough and County Constituencies) Charges Order, 1961 ( S.I. No. 203 of 1961 ).

4. The Returning Officers' (Borough and County Constituencies) Charges Order, 1937 (S.R. & O., No. 143 of 1937), shall have effect subject to the following changes in the Schedule:

(a) for the references (inserted by paragraph 2 of the Order of 1948), in subparagraph (1) of paragraph 1 of Section A of Part II to 4s. 3d., 4s. 0d. and 2s. 0d. there shall be substituted references to 5s. 6d., 5s. 0d. and 2s. 6d. respectively;

(b) for the references, in subparagraph (2) of paragraph 1 of Section A of Part II, to £3. 3s. 0d. and £9. 9s. 0d. there shall be substitued references to £4. 15s. 0d. and £14. 5s. 0d. respectively;

(c) for the references, in subparagraph (3) of paragraph 1 of Section A of Part II, to £l. 10s. 0d. there shall be substituted references to £2. 5s. 0d;

(d) for the references, in subparagraph (4) of paragraph 1 of Section A of Part II, to £25. 0s. 0d. and 5s. 0d. there shall be substituted references to £37. 10s. 0d. and 7s. 6d. respectively;

(e) for the references (inserted by paragraph 3 of the Order of 1961), in subparagraph (a) of paragraph (1) of Section B of Part II, to £4. 15s. 0d. and £5. 15s. 0d. there shall be substituted references to £5. 10s. 0d. and £6. 10s. 0d. respectively;

(f) for the reference (inserted by paragraph 3 of the Order of 1961), in subparagraph (b) of paragraph (1) of Section B of Part II, to £2, 10s. 0d. there shall be substituted a reference to £3. 10s. 0d;

(g) for the references (inserted by paragraph 3 of the Order of 1961), in paragraph (2) of Section B of Part II, to 5s. 6d., 6s. 0d., and 6s. 6d. there shall be substituted references to 7s. 6d., 8s. 0d., and 8s. 6d. respectively, and for the references in the said paragraph (2) to £5 and £2. 10s. there shall be substituted references to £7. 10s. 0d. and £3. 15s. 0d. respectively;

(h) for the references (inserted by paragraph 3 of the Order of 1961), in paragraph (3) of Section B of Part II, to 8s. 6d. and 8s. 0d. there shall be substituted references to 10s. 0d. and 9s. 6d. respectively, and for the references in the said paragraph (3) to £30. 0s. 0d., £20. 0s. 0d., £10. 0s. 0d. and £l. 10s. 0d., three shall be substituted references to £45. 0s 0d., £30. 0s. 0d., £15. 0s. 0d. and £2. 5s. 0d. respectively;

(i) for the reference (inserted by paragraph 2 of the Order of 1948), in subparagraph (c) of paragraph (3) of Section B of Part II, to 21s. 6d. there shall be substituted a reference to £l. 7s. 0d.;

(j) for the references in subparagraph (d) of paragraph (3) of Section B of Part II to 6s. 6d. and 11s. 6d. there shall be substituted references to 10s. 0d. and 15s. 0d. respectively;

(k) for the references in subparagraph (e) of paragraph (3) of Section B of Part II to 6s. 6d. and 11s. 6d. there shall be substituted references to 10s. 0d. and 15s. 0d. respectively;

(l) for the reference, in subparagraph (b) of paragraph 5 of Section B of Part II, to £10. 10s., there shall be substituted a reference to £15. 15s. 0d., and

(m) in the event of a re-examination and recount under paragraph (1B) (inserted by section 39 of the Electoral Act, 1963 (No. 19 of 1963)) of Rule 10 of the Third Schedule to the Electoral Act, 1923 (No. 12 of 1923), subparagraph (4) of paragraph 1 of Section A of Part II and paragraph (2) of Section B of Part II shall be construed as if the amounts set out in the said subparagraph (4) and the said paragraph (2) (as changed by the foregoing provisions of this paragraph) were increased by 75 per cent.; provided, however, that such a recount shall not be reckoned as a count beyond seven for the purposes of the said paragraph (2).

This Order increases the disbursements for Presiding Officers, Poll Clerks, counting of votes and clerical, etc. assistance at General Elections.
