LOCAL GOVERNMENT (SANITARY SERVICES) ACT, 1964 REGULATIONS, 1964.

The Minister for Local Government in exercise of the powers conferred on him by section 19 of the Local Government (Sanitary Services) Act, 1964 (No. 29 of 1964) hereby makes the following Regulations : —

1. These Regulations may be cited as the Local Government (Sanitary Services) Act, 1964 Regulations, 1964.

2. The forms in the Schedule hereto are hereby prescribed to be used for the purposes to which they relate by a sanitary authority exercising powers and duties under the Local Government (Sanitary Services) Act, 1964 .

SCHEDULE.

Form No. 1 (Notice under Section 7 (1) (b) of the Act).

NOTICE OF INTENTION TO ACQUIRE LAND COMPULSORILY UNDER THE LOCAL GOVERNMENT (SANITARY SERVICES) ACT, 1964 .

Notice is hereby given that the        in exercise of the powers conferred on them by the Local Government (Sanitary Services) Act, 1964 intend to acquire compulsorily under the said Act the land described hereunder. A map or plan of the said land has been deposited in     and may be seen during office hours.

Any occupier or owner of the said land may on or before the    day of    19 , submit to the sanitary authority an objection to the proposed acquisition. Any such objection must be in writing stating the grounds of the objection and addressed to the sanitary authority at

VESTING ORDER UNDER LOCAL GOVERNMENT (SANITARY SERVICES) ACT, 1964 .

WHEREAS the land described in the Schedule hereto is a dangerous place within the meaning of the Local Government (Sanitary Services) Act, 1964 (hereinafter called "the Act") or has ceased to be a dangerous place within the meaning of the Act by reason of work carried out by the sanitary authority under paragraph (a) of sub-section (1) of section 2 of the Act ;

AND WHEREAS the provisions of section 7 of the Act have been complied with by the (hereinafter called "the sanitary authority") in relation to the said land ;

AND WHEREAS no objection has been submitted to the sanitary authority in accordance with section 8 of the Act ; or

AND WHEREAS an objection was submitted to the sanitary authority in accordance with section 8 of the Act and was subsequently withdrawn ; or

AND WHEREAS the sum of £    remains due to the sanitary authority in relation to the said land under section 2 of the Act on foot of an order of the   Court dated the   day of 19 ; or

AND WHEREAS the Minister for Local Government has consented to the compulsory acquisition of the said land by the sanitary authority ;

NOW THEREFORE the sanitary authority in exercise of the power conferred on them by section 9 of the Local Government (Sanitary Services) Act, 1964 , hereby order that the land described in the Schedule hereto shall, on the day of 19 , vest in the sanitary authority in fee simple free from incumbrances and all estates, rights, titles, and interests of whatsoever kind.

1. Whichever of the third, fourth, fifth and sixth recitals as are inappropriate should be omitted.

2. The date of vesting should be not earlier than seven days after the making of the order.

NOTICE OF VESTING ORDER UNDER LOCAL GOVERNMENT (SANITARY SERVICES) ACT, 1964 .

Notice is hereby given that the have made the following vesting order under the Local Government (Sanitary Services) Act, 1964 :

Any person who, immediately before the making of the above order, had any estate or interest in or right in respect of the land acquired may apply to the       not later than twelve months after the making of the order for compensation in respect of the estate, interest or right.

EXPLANATORY NOTE.

These Regulations prescribe forms for use under sections 7 and 9 of the Local Government (Sanitary Services) Act, 1964 which sections relate to the compulsory acquisition by a sanitary authority of land which is or was a dangerous place.
