PIGS AND BACON ACTS, 1935 TO 1961 (PIGS AND BACON COMMISSION) INSURANCE ALLOWANCE (No. 1) ORDER, 1964.

WHEREAS sub-section (1) of Section 58 of the Act of 1937 (No. 23 of 1937) provides that the Pigs Marketing Board may, whenever and so often as it thinks fit, make an Order fixing the sum which is to be allowed in respect of each pig or carcase sold to a licensee, by way of insurance against the condemnation of such pig or carcase and the offals thereof by a veterinary examiner under Part II of the Principal Act or by a local sanitary authority under statutory powers.

AND WHEREAS sub-section (2) of Section 58 of the Act of 1937 provides that the Board may at any time by Order under this sub-section amend or revoke an Order made under this Section (including this sub-section).

AND WHEREAS by virtue of sub-section (1) of Section 22 of the Act of 1939 (No. 35 of 1939) the several powers and duties under the Acts of 1935 and 1937 which were formerly exercised or performed or capable of being exercised or performed by the Bacon Marketing Board and the Pigs Marketing Board respectively have been transferred to and are now vested in the Pigs and Bacon Commission (hereinafter referred to as " the Commission ").

AND WHEREAS sub-section (2) of Section 25 of the Act of 1939 provides that any Order made by the Pigs Marketing Board under Section 58 of the Act of 1937 and in force immediately before the transfer date shall, on and after the transfer date continue in force and have effect as if such Order were made by the Commission on the transfer date.

AND WHEREAS sub-section (1) of Section 37 of the Act of 1939 provides that every person who holds or has held a licence shall for each month commencing on or after the transfer date during the whole or any part of which he held such licence, pay to the Commission a levy, equivalent to the sum for the time being fixed as the insurance allowance by an Order made or deemed to have been made by the Commission under Section 58 of the Act of 1937, for each pig purchased by him and brought on to the premises to which such licence relates during such month.

AND WHEREAS the Commission has decided to exercise its powers under Section 58 of the Act of 1937 and make an Insurance Allowance Order.

NOW THEREFORE The Pigs and Bacon Commission hereby orders :

1. This Order may be cited as the Pigs and Bacon Acts, 1935 to 1961 (Pigs and Bacon Commission) Insurance Allowance (No. 1) Order, 1964.

2. In this Order the expression " the Act of 1937 " shall mean the Pigs and Bacon Act, 1937 (No. 23 of 1937) ; " the Act of 1939 " shall mean the Pigs and Bacon (Amendment) Act, 1939 (No. 35 of 1939) and subject as aforesaid and unless a contrary intention is indicated by the context all words and expressions used in this Order shall be construed as in the Pigs and Bacon Acts, 1935 to 1961.

3. This Order shall come into force on the 1st day of June, 1964.

4. The Insurance Allowance for the purpose of Section 58 of the Act of 1937 shall be one shilling and eight pence in respect of each pig or carcase sold to a Licensee.

5. The Order of the Commission dated 24th day of March, 1960, entitled " Pigs and Bacon Acts, 1935 to 1956 (Pigs and Bacon Commission) Insurance Allowance (No. 1) Order, 1960 ", shall be and is hereby revoked as and from the time this Order comes into force.

EXPLANATORY NOTE.

This Order fixes the amount to be deducted by the licensee in respect of each pig purchased and brought on to the licensed premises at one shilling and eight pence as from the 1st of June, 1964.
