SECONDARY TEACHERS' SUPERANNUATION (AMENDMENT) (NO. 2) SCHEME, 1963.

I, PÁDRAIG Ó hIRIGHILE, Minister for Education, in exercise of the powers conferred on me by the Teachers' Superannuation Act, 1928 (No. 32 of 1928), and with the consent of the Minister for Finance, hereby make the following Scheme:

1. This Scheme may be cited as the Secondary Teachers' Superanuation (Amendment) (No. 2) Scheme, 1963, and the collective citation "the Secondary Teachers' Superannuation Schemes, 1929 to 1963" shall include this Scheme.

2. This Scheme shall come into force immediately upon its being confirmed by each House of the Oireachtas.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. Paragraph 21 of the Secondary Teachers' Superannuation (Amendment) Scheme, 1951 ( S.I. No. 48 of 1951 ), is hereby amended by—

(a) the insertion of "who first gave approved teaching service on or before the 31st day of July, 1963" before "and who" in subparagraph (1),

(b) the substitution for subparagraph (2) of the following subparagraph, namely:

" (2) A person to whom a marriage gratuity has been paid under subparagraph (1) of this paragraph and who subsequently re-enters membership shall be ineligible to have her contributing service prior to her marriage reckoned for the purposes of the grant of a pension or the payment of the gratuities unless she repays to the pension fund the marriage gratuity paid to her together with compound interest thereon at the rate of five per cent. per annum calculated from the date on which she received the marriage gratuity to the date on which it is repaid."

(c) the insertion after subparagraph (3) (inserted by the Secondary Teachers' Superannuation (Amendment) Scheme, 1954 ( S.I. No. 234 of 1954 ) ) of the following subparagraph:

" (4) Payments to the pension fund under subparagraph (2) of this paragraph shall be of such amount, spread over so many years and subject to such conditions as the Minister may determine.", and

(d) the insertion of "having become a widow before she first re-enters such service," before "clause (b)" in subparagraph (3) (inserted by the said Secondary Teachers' Superannuation (Amendment) Scheme, 1954).

EXPLANATORY NOTE.

This Amending Scheme provides that a woman secondary teacher who commenced teaching after the 31st July, 1963, will not be eligible to receive a marriage gratuity.

In the case of a teacher who commenced teaching before the 31st July, 1963, and to whom a marriage gratuity is paid provision is made so that she may re-enter membership of the scheme and in the event of her re-entering she may have her service prior to her marriage reckoned as pensionable service if she refunds the marriage gratuity paid to her together with compound interest thereon at 5% per annum.
