SOCIAL WELFARE (OLD AGE (CONTRIBUTORY) PENSION) (TRANSITIONAL) (AMENDMENT) REGULATIONS, 1963.

I, CAOIMHGHÍN Ó BEOLÁIN, Minister for Social Welfare, in exercise of the powers conferred on me by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 66A of the said Act (inserted therein by section 13 of the Social Welfare (Amendment) Act, 1960 (No. 25 of 1960)), hereby make the following Regulations:—

1.—(1) These Regulations may be cited as the Social Welfare (Old Age (Contributory) Pension) (Transitional) (Amendment) Regulations, 1963.

(2) The Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 and 1961, and these Regulations may be cited collectively as the Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 to 1963.

2. These Regulations shall come into operation on the 3rd day of January, 1964.

3. In these Regulations "the Principal Regulations" means the Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 ( S.I. No. 255 of 1960 ).

4. Article 2 of the Principal Regulations is hereby amended by the substitution in the definition of "entry into insurance" for the words "his last" of the word "any".

5. Article 6 of the Principal Regulations is hereby amended by—

(a) (i) the insertion in paragraph (b) of sub-article (1) after the word "or" of the words ", if entry into insurance occurred after he had attained the age of fifty five years but before he had attained the age of sixty years,"

(ii) the deletion from the said paragraph of the words "whichever is the shorter period." and

(iii) the addition to the end of the said paragraph of the word "or";

(b) the addition to sub-article (1) of the following paragraph:—

"(c) in the period of the last twenty complete contribution years before he attained pensionable age or, if entry into insurance occurred after he had attained the age of fifty years but before he had attained the age of fifty-five years, the period from the beginning of the contribution year in which entry into insurance occurred to the end of the last complete contribution year before he attained pensionable age.";

(c) the deletion of paragraph (b) of sub-article (2) and the insertion of the following paragraphs:—

"(b) where the former contributor had attained the age of fifty-five years before the 5th day of January, 1953, as respects a man, or the 6th day of July, 1953, as respects a woman,

(i) in the period of the last fifteen complete contribution years before he attained pensionable age, or, if entry into insurance occurred after he had attained the age of fifty-five years but before he had attained the age of sixty years, in the period from the beginning of the contribution year in which entry into insurance occurred to the end of the last complete contribution year before he attained pensionable age, or

(ii) in the period of the last twenty complete contribution years before he attained pensionable age, or, if entry into insurance occurred after he had attained the age of fifty years but before he had attained the age of fifty-five years, the period from the beginning of the contribution year in which entry into insurance occurred to the end of the last complete contribution year before he attained pensionable age, or

(c) where the former contributor is not a person to whom paragraph (b) hereof applies and had attained the age of fifty years before the 5th day of January, 1953, as respects a man, or the 6th day of July, 1953, as respects a woman, in the period of the last twenty complete contribution years before he attained pensionable age, or, if entry into insurance occurred after he had attained the age of fifty years but before he had attained the age of fifty-five years, in the period from the beginning of the contribution year in which entry into insurance occurred to the end of the last complete contribution year before he attained pensionable age.".

EXPLANATORY NOTE.

One of the conditions for the receipt of old age (contributory) pension is that the claimant must have a yearly average of not less than 48 contributions paid or credited to the end of the last contribution year before reaching the age of 70. The maximum period over which this average could be calculated in the case of a person who was insured under the National Health Insurance Acts was previously 15 years. These Regulations provide that in the case of such a person, the period over which this average is calculated may be extended to a maximum of 20 years before he attained the age of 70.
