COMMITTEES OF AGRICULTURE (OFFICERS' TRAVELLING EXPENSES AND MAINTENANCE ALLOWANCE AND EXPENSES) REGULATIONS, 1956 (AMENDMENT) REGULATIONS, 1963.

I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by section 28 of the Agriculture Act, 1931 (No. 8 of 1931), and section 6 of the Agriculture (Amendment) Act, 1958 (No. 17 of 1958), hereby make the following regulations:

1. (1) These Regulations may be cited as the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 (Amendment) Regulations, 1963.

(2) These Regulations shall be deemed to have come into operation on the 1st day of January, 1963.

(3) The Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 to 1961, and these Regulations may be cited together as the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 to 1963.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. Part III of the Schedule to the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 ( S.I. No. 70 of 1956 ), is hereby amended by the deletion of paragraphs 10 and 11 (inserted by the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 (Amendment) Regulations, 1961 ( S.I. No. 244 of 1961 ) ) and the substitution therefor of the following paragraphs;

" 10. (1) Subject to the provisions of paragraph 9 of this Schedule, the following shall be the rates of maintenance expenses in the form and by way of a night allowance which shall be payable by a committee to its officers, that is to say—

(a) in the case of a Chief Agricultural Officer or a Secretary of a committee, the rate shall be forty-four shillings and three pence per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of forty-four shillings and three pence shall be reduced to the rate of forty shillings and nine pence per night for the remainder of the officer's stay;

(b) in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is in receipt of a salary of more than £747 per annum, the rate shall be thirty-nine shillings and nine pence per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of thirty-nine shillings and nine pence shall be reduced to the rate of thirty-four shillings per night for the remainder of the officer's stay;

(c) in the case of an officer who is in receipt of a salary of not less than £455 and not more than £747 per annum, the rate shall be thirty-three shillings and three pence per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of thirty-three shillings and three pence shall be reduced to the rate of twenty-seven shillings and sixpence per night for the remainder of the officer's stay, and

(d) in the case of an officer who is in receipt of a salary of less than £455 per annum, the rate shall be twenty-eight shillings and nine pence per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of twenty-eight shillings and nine pence shall be reduced to the rate of twenty-four shillings and three pence per night for the remainder of the officer's stay.

(2) In this paragraph "salary" shall be construed as excluding any allowance for travelling and maintenance allowances.

11. The following shall be the rates of maintenance expenses in the form and by way of a day allowance payable by a committee to such of its officers as are entitled to a day allowance, that is to say—

(a) in the case of a Chief Agricultural Officer or a Secretary of a committee who is absent from headquarters for a period of not less than ten hours (not extending overnight) or a period of not less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be one-third of the rate payable to the officer in the case of a night allowance applicable to the first seven nights of a continuous period of absence by the officer in any one place;

(b) in the case of a Chief Agricultural Officer or a Secretary of a committee who is absent from headquarters for a period of not less than seven but less than ten hours (not extending overnight) or a period of not less than seven but less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be seven shillings;

(c) in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is absent from headquarters for a period of not less than ten hours (not extending overnight) or a period of not less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be one-third of the rate payable to the officer in the case of a night allowance applicable to the first seven nights of a continuous period of absence by the officer in any one place;

(d) in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is absent from headquarters for a period of not less than seven but less than ten hours (not extending overnight) or a period of not less than seven but less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be—

(i) six shillings, in case the rate of night allowance payable to the officer in respect of the first seven nights of a continuous period of absence in any one place is thirty-nine shillings and nine pence;

(ii) five shillings and nine pence, in case the rate of night allowance payable to the officer in respect of the first seven nights of a continuous period of absence in any one place is either thirty-three shillings and three pence or twenty-eight shillings and nine pence ".

EXPLANATORY NOTE.

These Regulations provide for increased maintenance expenses in the form of night and day allowances for officers of Committees of Agriculture as from 1st January, 1963.
