DEFENCE FORCES (REGISTRATION OF CERTAIN BIRTHS AND DEATHS OCCURRING OUTSIDE THE STATE) REGULATIONS, 1962.

I, GEARÓID MAC PHARTHALÁIN, Minister for Defence, in exercise of the powers conferred on me by section 6 of the Defence (Amendment) (No. 2) Act, 1960 (No. 44 of 1960), and with the consent of the Minister for Health, hereby make the following regulations :—

1.—(1) These Regulations may be cited as the Defence Forces (Registration of Certain Births and Deaths Occurring Outside the State) Regulations, 1962.

(2) These Regulations shall be deemed to have come into operation on the 1st day of October, 1960.

2. In these Regulations—

" appropriate officer " means—

(a) in respect of a member of a unit of the Permanent Defence Force that is serving outside the State with an International United Nations Force, or the wife or a relative or dependant of the member, the officer commanding the unit,

(b) in respect of a member of the Permanent Defence Force who is serving outside the State with an International United Nations Force in a group of members of the Permanent Defence Force that is not a unit of the Permanent Defence Force, or in respect of the wife or a relative or dependant of the member, the senior officer for the time being in the group,

(c) in respect of any other member of the Permanent Defence Force who is serving outside the State with an International United Nations Force, or the wife or a relative or dependant of the member, the Adjutant-General;

" the Principal Act " means the Defence (Amendment) (No. 2) Act, 1960 (No. 44 of 1960);

" Adjutant-General ", " officer " and " Permanent Defence Force " have the meanings respectively assigned to them by section 2 of the Defence Act, 1954 (No. 18 of 1954);

" International United Nations Force " has the meaning assigned to it by section 1 of the Principal Act.

3.—(1) The appropriate officer shall keep a record of the death of a member of the Permanent Defence Force occurring outside the State while the member is serving outside the State with an International United Nations Force.

(2) A record kept pursuant to this Regulation shall be in the form set out in the First Schedule to these Regulations and contain the particulars required by the form.

4.—(1) The appropriate officer shall keep a record of the death of the wife, or of a relative or dependant of a member of the Permanent Defence Force ordinarily residing with the member, occurring outside the State while the member is serving outside the State with an International United Nations Force.

(2) A record kept pursuant to this Regulation shall be in the form set out in the First Schedule to these Regulations and contain the particulars required by the form.

5.—(1) The appropriate officer shall keep a record of the birth of a child to the wife of a member of the Permanent Defence Force occurring outside the State while the member is serving outside the State with an International United Nations Force.

(2) A record kept pursuant to this Regulation shall be in the form set out in the Second Schedule to these Regulations and contain the particulars required by the form.

(3) A record kept pursuant to this Regulation shall be signed, in column (8) of the form in which it is kept opposite the signature of the officer compiling the record, by the person who informed that officer of the birth to which it relates and the date of such signing shall be inserted in the said column.

6. A record shall not be kept under Regulation 4 or 5 of these Regulations of the death of, or of the birth of a child to, a person unless the United Nations or the Adjutant-General had consented, prior to the death or birth, as the case may be, to the person's accompanying the member of the Permanent Defence Force of whom the person was the wife or a relative or dependant, as the case may be, while the member was serving outside the State with an International United Nations Force.

7. A record kept under these Regulations by an officer other than the Adjutant-General shall be transmitted by that officer to the Adjutant-General as soon as may be after its compilation.

8. A record kept pursuant to Regulation 3, 4 or 5 of these Regulations shall be given a number by the Adjutant-General and the number shall be inserted by the Adjutant-General in column (1) of the form in which the record is kept opposite the particulars of the death or birth, as the case may be, to which the record relates.

9. A record kept under these Regulations shall be authenticated by the Adjutant-General by his signing his name, and inserting thedate of such signing, in column (10) of the form in which the record is kept opposite the signature of the officer who compiled the record and the record shall be transmitted by registered post or special military dispatch to an tÁrd-Chláraitheóir by the Adjutant-General as soon as may be after such authentication.

10. (a) An entry made in the Defence Forces Deaths Register Book by an tÁrd-Chláraitheóir, pursuant to subsection (3) of section 6 of the Principal Act, of a record of a death transmitted to him under the said section 6 shall be a copy of the record.

(b) An entry made in the Defence Forces Births Register Book by an tÁrd-Chláraitheóir, pursuant to the said subsection (3), of a record of a birth transmitted to him under the said section 6 shall be a copy of the record.

EXPLANATORY NOTE.

These regulations provide for the registration of the deaths of members of the Permanent Defence Force, their wives and other members of their families and the birth of children to the wives of members of the Permanent Defence Force occurring outside the State while the members of the Permanent Defence Force are serving outside the State with an International United Nations Force.
