MEDICAL REGISTRATION COUNCIL ELECTION (AMENDMENT) RULES, 1962

The Minister for Health in exercise of the powers conferred on him by subsection (4) of section 11 and subsection (2) of section 12 of the Medical Practitioners Act, 1927 (No. 25 of 1927) as adapted by the Local Government and Public Health (Alteration of Name of Department and Title of Minister) Order, 1947 (S.R. and O. 1947, No. 16) and the Health (Transfer of Departmental Administration and Ministerial Function) Order, 1947 (S.R. and O. 1947, No. 58) hereby makes the following Rules :—

1. These Rules may be cited as the Medical Registration Council Election (Amendment) Rules, 1962.

2. The Medical Registration Council Election Rules 1927 (S.R. and O., 1927, No. 56) shall be amended as follows :—

(a) in Rule 3, the words " and of the day on which (if the election is contested) the votes will be counted " shall be deleted ;

(b) in Rule 6, the sentence " Where application is made for a nomination paper to be sent by post, the cost of the postage shall be prepaid by the applicant " shall be deleted ;

(c) in paragraph (4) of Rule 15, the words " in the presence of the candidates " shall be deleted ;

(d) the following Rule shall be substituted for Rule 19 :—

"19 (1) The returning officer shall retain for twelve months from the completion of the election in separate packets sealed with his seal the voters list, the declarations of identity, the valid and invalid voting papers and the packet containing the counterfoils of the voting papers and the unused voting papers and shall, at the end of the said period of twelve months destroy all the said packets unless a court having jurisdiction in that behalf has otherwise ordered.

(2) No person shall be allowed to inspect any of the sealed packets retained by the returning officer or any of the contents thereof except under and in accordance with an Order of a court having jurisdiction in that behalf."

(e) In the Schedule to the Rules, the following form shall be substituted for Form No. 1:—

NOTICE OF ELECTION

Notice is hereby given that pursuant to the Medical Practitioners Act, 1927 an election of............. registered medical practitioner/practitioners to be a member/members of the Medical Registration Council is about to be held. Nomination papers and further details of the election may be obtained on application to the undersigned at the offices of the Medical Registration Council, 68 Fitzwilliam Square, Dublin, 2. Completed nomination papers must be delivered to the returning officer at the said offices on or before the........................................ The returning officer will attend to receive nominations at the said offices between the hours of....... and...................on the .............day of...........................

EXPLANATORY NOTE

These Rules amend the Medical Registration Council Election Rules, 1927 (S.R. and O. 1927 No. 56) by providing for a revised form of notice of the holding of an election of members of the Medical Registration Council. They also make some minor amendments in relation to the procedure for the election of members.
