S.I. No. 45/1962 - Garda Síochána Pay Order, 1962.


I, CHARLES J. HAUGHEY, Minister for Justice, in exercise of the powers conferred on me by section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), with the sanction of the Minister for Finance and after due compliance with subsection (2) of the said section 12, hereby order as follows :

1. This Order may be cited as the Garda Síochána Pay Order, 1962.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In the case of a member of the Garda Síochána who—

(a) was dismissed from the Garda Síochána on the 9th day of November, 1961,

(b) was reinstated in the Garda Síochána on the 14th day of November, 1961,

and

(c) had not, on the said 9th day of November, 1961, completed his period of probationary service in the Garda Síochána,

the Minister for Justice may, notwithstanding Article 10 of the Garda Síochána Pay (No. 2) Order, 1958 ( S.I. No. 156 of 1958 ), on the recommendation of the Commissioner of the Garda Síochána, and subject to the sanction of the Minister for Finance, allow the previous service of the member to be reckoned either in whole or in part as he may think fit for the purposes of pay after reinstatement.

EXPLANATORY NOTE.

This Order enables the previous service of a particular member of the Garda Síochána who was dismissed, while on probation, and subsequently reinstated, to be reckoned for purposes of pay.
