RETURNING OFFICERS' (BOROUGH AND COUNTY CONSTITUENCIES) CHARGES (No. 2) ORDER, 1961.

I, SÉAMAS Ó RIAIN, Minister for Finance, in exercise of the powers conferred on me by subsection (5) of section 25 of the Electoral Act, 1923 (No. 12 of 1923), hereby order as follows:

1.—(1) This Order may be cited as the Returning Officers' (Borough and County Constituencies) Charges (No. 2) Order, 1961.

(2) This Order shall be deemed to be included in the citation Returning Officers' (Borough and County Constituencies) Charges Orders, 1937 to 1961.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Returning Officers' (Borough and County Constituencies) Charges Order, 1937 (S.R. & O., No. 143 of 1937), is hereby amended by—

(a) the insertion in paragraphs (3) and (5) of Section 13 of Part II of the Schedule of the following subparagraph:

"(cc) For the assistance of a special legal assessor employed by the Returning Officer with the prior consent of the Minister for Local Government . . . Such sum as may be authorised by the Minister for Finance,"

and

(b) the insertion in subparagraph (b) of the said paragraph (5) after "day of nomination" of "excluding any services for which payment is otherwise authorised by this Scale".

EXPLANATORY NOTE.

The purpose of this Order is to enable the Returning Officer, with the prior consent of the Minister for Local Government, to employ a special legal assessor in connection with a Dáil Election and to pay him such sum as may be authorised by the Minister for Finance.
