AGRICULTURAL PRODUCE (EGGS) (AMENDMENT) REGULATIONS, 1961

I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by sections 4 , 35 , 38 , 42 and 59 of the Agricultural Produce (Eggs) Act, 1939 (No. 2 of 1939), as amended by the Agricultural Produce (Eggs) Act, 1961 (No. 15 of 1961), hereby order as follows:

1.—(1) These Regulations may be cited as the Agricultural Produce (Eggs) (Amendment) Regulations, 1961.

(2) The Agricultural Produce (Eggs) Regulations, 1939 to 1960, and these Regulations shall be construed as one and may be cited together as the Agricultural Produce (Eggs) Regulations, 1939 to 1961.

2. These Regulations shall come into operation on the 16th day of October, 1961.

3. In these Regulations "the Principal Regulations" means the Agricultural Produce (Eggs) Regulations, 1939 (S.R. & O., No. 169 of 1939).

4. Article 15 of the Principal Regulations is hereby amended by—

(a) the substitution of "Large" for "Specials" in each place where it occurs,

(b) the substitution of "Medium" for "Selected" in each place where it occurs,

(c) the substitution of "Small" for "Pullets" in each place where it occurs,

(d) the substitution of "1 oz. 10 drams" for "1 oz. 11 drams" in each place where it occurs,

(e) the substitution of "1 oz. 8 drams" for "1 oz. 9 drams" in each place where it occurs, and

(f) the deletion of all words and figures after "drams" in subparagraphs (a), (b), (c) and (d) of paragraph (2) and in subparagraphs (a), (b), (c), (d), (e), (f), (g), (h), (i), (j), (k) and (l) of paragraph (3).

5. Paragraph (1) of Article 16 of the Principal Regulations shall not apply in relation to fresh eggs consigned otherwise than for export.

6.—(1) Before being despatched from registered wholesaler's premises fresh eggs (except eggs sold under licence) consigned for export shall, in addition to the marks specified in Article 16 of the Principal Regulations, be marked with the following marks, that is to say:

(a) a mark consisting of whichever of the following words is appropriate to the grade of the eggs, that is to say:

Large

Standard

Medium

Small,

and

(b) a mark consisting of the identification letter and number assigned to the premises from which the eggs are consigned and the marks prescribed by this paragraph shall be enclosed in a circle of not less than one-half of an inch in diameter.

(2) All letters and figures constituting any mark prescribed by the foregoing paragraph shall be in block type and shall be not less than one-twelfth of an inch high.

7. Article 18 of the Principal Regulations is hereby amended by—

(a) the substitution of "Large" for "Specials" in each place where it occurs,

(b) the substitution of "Medium" for "Selected" in each place where it occurs,

(c) the substitution of "Small" for "Pullets" in each place where it occurs, and

(d) the deletion of paragraph 6 (inserted by the Agricultural Produce (Eggs) (Amendment) Regulations, 1950 ( S.I. No. 127 of 1950 )).

8. For the purposes of Part VI (inserted by the Agricultural Produce (Eggs) Act, 1961 (No. 15 of 1961)) of the Principal Act the following articles are hereby prescribed as egg products, that is to say, any articles of commerce which are manufactured or derived wholly or partly from eggs and which consist of or pass in commerce as—

(a) whole egg (not in shell),

(b) egg yolk, or

(c) egg albumen or egg white,

whether in a liquid, frozen, dried or crystallised state.

EXPLANATORY NOTE

The Regulations provide that, as from 16th October, 1961—

the descriptions "Large", "Medium" and "Small" shall be substituted for "Specials", "Selected" and "Pullets", respectively, in the names of the prescribed egg grades;

the prescribed grade weights shall be modified so as to abolish the requirement of a minimum grade weight in respect of each great hundred eggs and to enable

(a) individual eggs weighing less than 1 oz. 11 drams but not less than 1 oz. 10 drams, and

(b) individual eggs weighing less than 1 oz. 9 drams but not less than 1 oz. 8 drams,

to be included in the "Medium" and "Small" grades, respectively;

fresh eggs which are consigned from registered wholesaler's premises otherwise than for export shall not require to be marked with prescribed marks;

fresh eggs which are consigned from registered wholesaler's premises for export shall, in addition to being marked with the origin mark and the appropriate code mark, be marked with prescribed marks to indicate the grade of the eggs and the premises from which the eggs are consigned; and

such articles as are prescribed in Article 8 of the Regulations shall be egg products for the purposes of Part VI of the Agricultural Produce (Eggs) Act, 1939 .
