SOCIAL WELFARE (OLD AGE (CONTRIBUTORY) PENSION) (TRANSITIONAL) (AMENDMENT) REGULATIONS, 1961.

I, SEÁN MacENTEE, Minister for Social Welfare, in exercise of the powers conferred on me by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 66A of the said Act (inserted therein by section 13 of the Social Welfare (Amendment) Act, 1960 (No. 25 of 1960) ), hereby make the following Regulations:—

1.—(1) These Regulations may be cited as the Social Welfare (Old Age (Contributory) Pension) (Transitional) (Amendment) Regulations, 1961.

(2) The Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 ( S.I. No. 255 of 1960 ) and these Regulations may be cited together as the Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 and 1961.

2. The Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960 shall be amended by the addition thereto of the following article:—

"9.—(1) Where a person ceased to be an employed contributor under the National Health Insurance Acts and his insurance under those Acts would subsequently have ceased but for contributions which are excepted contributions within the meaning of these Regulations, his insurance under those Acts shall for pension purposes be deemed to have ceased on the date on which it would have ceased but for the excepted contributions.

(2) Where a person whose insurance under the National Health Insurance Acts is deemed to have ceased under this article again became an employed contributor under those Acts subsequent to the date on which such insurance is deemed to have ceased he shall for pension purposes be regarded as having become an insured person under those Acts at the commencement of the week in which he again became an employed contributor, and the provisions of article 6 of the National Health Insurance (Arrears) Regulations, 1946 (S.R. and O. No. 223 of 1946) shall be deemed then to have applied to him."

EXPLANATORY NOTE.

The insurance of a person under the National Health Insurance Acts ceased twelve or eighteen months after he ceased insurable employment or ceased to pay contributions as a voluntary contributor. The periods of free insurance were extended by any intervening periods of incapacity for work.

These Regulations amend the Social Welfare (Old Age (Contributory) Pension) (Transitional) Regulations, 1960, to provide that excepted contributions within the meaning of those Regulations shall not, for old age (contributory) pension purposes, extend a person's insurance under the National Health Insurance Acts beyond the date where it would have ceased if there were no excepted contributions. These Regulations further provide that where a person's insurance under the National Health Insurance Acts thus ceased far old age (contributory) pension purposes and he again became an employed contributor under those Acts, the provisions of the National Health Insurance (Arrears) Regulations, 1946, whereby contributions were deemed to have been paid by a person from the commencement of the contribution year in which he entered insurance shall, for pension purposes, apply to him.
