EMPLOYMENT REGULATION ORDER (PROVENDER MILLING JOINT LABOUR COMMITTEE), 1961.

WHEREAS pursuant to the provisions of Section 43 of the Industrial Relations Act, 1946 (hereinafter called " the Act ") the Provender Milling Joint Labour Committee (hereinafter called " the Committee ") has submitted to the Labour Court (hereinofter called " the Court ") the proposals set out in the Schedule hereto, for fixing the minimum rates of remuneration and regulating the conditions of employment of workers in relation to whom the Committee operates ;

AND WHEREAS the provisions of Section 43 of the Act have been complied with ;

NOW, THEREFORE, the Court, in exercise of the powers conferred on it by Section 43 of the Act hereby orders as follows :—

1. This Order may be cited as the Employment Regulation Order (Provender Milling Joint Labour Committee) 1961.

2. Effect is hereby given to the proposals set out in the Schedule hereto.

3. The provisions set out in the Schedule hereto shall have effect as from the 3rd day of June, 1961.

SCHEDULE

STATUTORY MINIMUM REMUNERATION AND CONDITIONS OF EMPLOYMENT

In this Schedule—

ZONE A means the County Boroughs of Dublin, Cork, Limerick and Waterford.

ZONE B means the Boroughs of Drogheda, Sligo, Wexford, Galway, Kilkenny and Clonmel and the Urban Districts of Dundalk and Tralee including in each case an area within a radius of 3 miles from the central post office.

ZONE C means all other Areas.

Section I.—Workers To Whom This Schedule Applies

Workers, other than carters and lorry drivers, employed in the manufacture for sale (including packing where such packing is carried on in conjunction with such manufacture) of animal feeding stuffs by any process whatsoever including the grinding, cutting or flaking of cereals and the mixing of one substance with another substance but excluding production merely by natural agencies or in the course of ordinary farm husbandry.

" Animal feeding stuff " means any article manufactured for use as food for horses, mules, jennets, asses, cattle, sheep, swine, goats or poultry, but does not include grass meal.

NORMAL WORKING HOURS

The normal number of hours to be worked by workers other than shift workers in relation to whom the Committee operates shall be as follows :—

Section 3.—Shift Workers

The normal number of hours to be worked by workers employed under a Shift Work Licence granted by the Minister for Industry and Commerce shall be the hours prescribed in such Licence.

Section 4.—Overtime Rates

The Minimum Rates for Overtime, which shall be calculated on a daily basis, to apply in respect of hours worked by Male and Female Workers in excess of the normal number of hours of work shall be as follows:—

(a) For all time worked in excess of the normal number of hours of work, the Overtime Rate shall be one-and-a-half times the General Minimum Time-rate otherwise applicable—i.e., Time-and-a-half, except in so far as Double Time is payable under the provisions of paragraph (b) of this Section.

(b) For all time worked on Sundays or statutory public holdiays (or customary public holidays substituted therefor) the overtime rate shall be twice the general minimum time-rate otherwise applicable, i.e., double time.

Section 5.—Shift Work Allowances

Shift Workers shall receive in addiiton to the basic statutory minimum remuneration a shift allowance as follows :—

(a) Third or Night Shift, in accordance with the terms of the Shift Work Licence granted by the Minister for Industry and Commerce, an allowance in addition to the statutory minimum remuneration : 5/-

(b) Second or Evening Shift, as above : 2/6d.

These allowances shall not be computable for overtime.

Section 6.—Holidays and Holiday Remuneration

(a) Workers in relation to whom the Committee operates and who qualify for annual leave under Section 10 of the Holdiays (Employees) Act, 1939, or who would so qualify were it not for Section 2(a) of that Act, shall in addition to the seven consecutive whole holidays prescribed therein be granted a further period of seven consecutive whole holidays, and the payment in respect of this further period shall be calculated in the same manner as that for the statutory period provided for by that Act.

(b) Notwithstanding the provisions of (a) above the management of any particular establishment affected by the Order may by arrangement with any worker concerned therein substitute for the further period of seven consecutive whole holidays six single days' holidays with pay.

EXPLANATORY NOTE.

This Instrument fixes minimum rates of pay and conditions of employment of workers employed in the Provender Milling Industry. It is made by the Labour Court on the recommendation of the Provender Milling Joint Labour Committee.
